Dear Ms. Canedo:
The Community Development Department has reviewed your Minor Adjustment
application (MA 2015-0004), pursuant to Section 9.210.040 of the City of La
Quinta Zoning Code.
REQUEST:
An adjustment under the 10% maximum allowed be applied to the 20-foot front
yard setback depth (Section 9.30.040.C) from twenty feet (20') to 18 feet, 3
and 1 /8 Inches (18' 3 1 /8") to allow for the construction of a structural addition
to the main residential unit on the subject lot.
DECISION:
Approval is granted for the requested adjustment based on the following findings
and subject to the conditions of approval listed below:
1. Minor Adjustment 2015-0004 is consistent with the La Quinta General Plan,
in that the proposal does not alter the approved land use for the property, or
affect land use on surrounding similar properties.
2. Minor Adjustment 201'5-0004 is consistent with the intent of the La Quinta
Zoning Code, in that the requested adjustment is required to comply with. all
other applicable development standards under said Zoning Code.
3. Processing and approval of Minor Adjustment 2015-0004 has complied with
the California Environmental Quality Act (CEQA). The adjustment requested
is determined to be categorically exempt from CEQA under Guidelines
Section 15305(a) as a "Minor Alterations to Land" - Class 5 Categorical
Exemption. Therefore, no environmental review is necessary.
4. Approval of Minor Adjustment 2015-0004 is not detrimental to the public
health, safety and .general welfare, 'nor injurious or incompatible with other
properties and land use in the vicinity. The adjustment has no impact on
health or safety. issues, and will not affect physical land use characteristics in
the vicinity.

CONDITIONS OF APPROVAL:
1. MA. 2015-0004 is approved for the maximum 10% reduction, up to two
feet (2') to the required twenty :foot .(20'). required front yard setback; the
front yard setback may therefore be reduced to a minimum of eighteen
feet (18') under this approval.
2. The proposed construction shall comply with all other development
standards as required under the La Quinta Zoning Code. Specifically, the
garage improvement shown is not a part of this approval and its location
and/or design shall be revised to meet the minimum required garage
setback of 20 feet (20'), as set forth under LQMC Section 9.30.040.C.
3. A building permit shall be obtained prior to any construction.
Please be advised that only one Minor Adjustment may be approved for any
single parcel, regardless of the percentage of the development standard
adjusted. This approval relates only to allowance of the adjustment as stated
herein, and does not imply any entitlement or approval of a building permit for
any structure(s) shown on the plans as submitted.. All other development
standards of the La Quinta Zoning Code shall be adhered to in preparing plans
for building plan check.
