JUSTIFICATION: No request for a setback.adjustment shall be granted.unless it is determined
that the adjustment is consistent with the intent and purposes of this Ordinance; that there
are special circumstances applicable to the property, including such factors as size, shape,
topography, location or surroundings that justify the approval of the adjustment of the setback
requirement, and that the adjustment will not be detrimental to the health, safety, and general
welfare of the community or be detrimental to property in the vicinity of the parcel for which
the adjustment is requested.

This letter is to report approval of your recent application for a setback adjust-
ment, pursuant to -Section 18.33 of Ordinance 348, to permit a three-foot encroach-
ment into the required five-foot side yard setback, subject to the following
conditions:

1. The developiaent of the pre -raises shall conform substantially with that as shown
on plot plan marked Exhibit "A" on file with Setback Adjustment No. 450 1n the
Riverside County Planning Department.
2. Construction shall be permitted only as approved by the Departr;eent of Building
and Safety of Riverside County.
3. The air conditioning unit shall be completely screened from vier Dy Plantings
or structure such as opaque fence or wall.
4. This approval shall be used within six months of the date of this letter.
It has been determined from a study of the case that special circumstances applicable
to the property do exist. lue to size and shape of the lot. if the modification were
not granted, the subject property would be deprived of privileges enjoyed by other
properties in the -vicinity and the same zono classification.
