JUSTIFICATION: No request for a Setback Adjustment shall be granted
unless it is determined that the adjustment is consistent with the
intent and purpose of this Ordinance; that there are special
circumstances applicable to the property, including such factors as
size, shape, topography, location or surroundings that justify the
approval of the adjustment of the setback requirement, and that the
adjustment will be not detrimental to the health, safety, and general
welfare of the community or be detrimental to property in the vicinity
of the parcel for which the adjustment is requested.

Subject: Setback Adjustment #88-001
Dear Ms. Rackie:
This is to report that the Planning and Development Director
has approved the above -referenced request in accordance with
Chapter 9.188, Title 9 of the La Quinta Municipal Code,, subject
to the following conditions.
1. The applicant shall provide, to the Building
Division an adequate drainage plan for conveyance
of runoff and nuisance water, to insure that there
is proper channelization of said water to an
approved drainage way.
2. The applicant shall obtain written permission from
the golf course owner, or his authorized agent, to
allow for drainage conveyance over their property.
This shall be provided to the Building Division
prior to,building permit issuance.
3. These conditions shall be made part of the
building permit for which this adjustment is
contemplated. The conditions herein shall be
addressed to the satisfaction of the Planning and
Building Divisions prior to the release of any
permit for. site construction.
This approval shall become effective 15 days from the date of
this letter, unless an appeal is filed in accordance with
Section 9.180.060 of the La Quinta Municipal Code.

.Dear Ms. Rackie:
The property owners in the area have contacted our office and
informally indicated that the Association does not support your
request. Without any other compelling reason, this Department
is inclined to deny your request. /You should contact the
property owners association, Mr. Reynolds, to work out a
compromise in order to obtain their support. With their
support this Department would consider granting the adjustment.
Upon your advise, we%would-'formalize the action,�yto decline, your
request, to enable you to appeal this matter to the City
Planning Commission. This officemaybe contacted for the
procedure to institute an appeal..

I need your special help concering a setback adjustr.:ent
between the back of my house and the Indian Springs Golf Course.
Location: 46-250 South Jefferson on the North side of
hwy Ill, third house on the right going North to the
Club House.
Reason for the change: We have a large water probler:
64 feet X 10 feet patic setting 1-and one-half feet
Delon: the Golf Course, surrounded by a wall holding the
water like a pool, that rust be pu;rced out when it rains.

and I get anouther room, and the tax man gets more
money.
