fee of $100 is required when the Application is submitted. Check must
be made payable to the "City of La Quinta".

Dear Mr. Hill:
Your application for Setback Adjustment is hereby approved.
This approval is subject to compliance with Exhibit "B" (unit
siting plan) as contained in the Planning and Development
Department Tentative Tract File No. 23813.
The City of La Quinta Planning and Zoning Regulations state the
following:
"9.188.050 Conditions for Setback Adjustment. No
request for a Setback Adjustment shall be granted unless
it is determined that the adjustment is consistent with
the intent and purposes of this title; that there are
special circumstances applicable to the property,
including such factors as size, shape, topography,
location or surroundings that justify the approval of the
adjustment of the setback requirement, and that the
adjustment will not be detrimental to the. health, safety
and general welfare of the community or be detrimental to
property in the vicinity of the parcel. for which the
adjustment is requested."
In the above case it was found that:
1. The size and shape of the property restricted the
placement of the housing units; and
2. All units requiring setbacks lie within this planned unit
development. None of these units abut any existing
housing units and therefore, will have no detrimental
affect on the surrounding community.
