JUSTIFICATION: No request for a Setback Adjustment shall be granted
unless it is determined that the adjustment is consistent with the n
intent and purpose of this Ordinance; that there are special NO
circumstances applicable to the property, including such factors as
size, shape, topography, location or surroundings that justify the
approval of the adjustment of the setback requirement, and that the
adjustment will be not detrimental to the health, safety, and general
welfare of the community or be detrimental to property in the vicinity
of the parcel for which the adjustment is requested.

Subject: Setback Adjustment #88-004, 78-520 Bottlebrush Drive
Dear Mr. Lucas:
Regarding the above subject, the Planning and Development
Department has approved your request based on the following
facts and findings:
FACTS
1. Bottlebrush Drive will be treated as a cul-de-sac along
he subject property, as provided in the Washington Street
Specific Plan.
2. The Washington Street Specific Plan provides that direct
individual uncontrolled access to Washington Street shall be
limited.
3. The City is processing a Lot Line Adjustment application to
adjust the boundary between Lots 49 and 50 so as to front onto
Bottlebrush Drive.
Due to these facts, special circumstances are deemed applicable to
the subject property..
FINDINGS '
1. Approval of SBA #88-004 is consistent with the Washington
Street Specific Plan and the La Quinta General Plan.
2. Location and surroundings affecting this property
indicate that approval of SBA #88-004 is necessary to the
health, safety, and general welfare of the community.
3. Approval of SBA #88-004 will not be detrimental to any
property in the vicinity of the parcel in question.
4. Approval of SBA #88'-004 is consistent with the purpose
and intent of the provisions of Title 9 of the La Quinta
Municipal Code.

This approval is subject to the following conditions:
1. Development of the site shall be in' compliance with all
applicable Cite of La Quinta codes and ordinances as in
effect and Exhibit "A" on file with the ,Planning and
Development Department, except where these conditions
take precedence.
2. No construction activity may take place until such time
as Lot Line Adjustment #89-050' has been approved by the
Planning and Development Department.
3. Lot Line Adjustment #89-050 shall be required to allow for
minimum depth, and width standards as set forth in Chapter
9.42 of the La Quinta Municipal Code.
4. The adjustment shall only be for an allowance of a 15 foot
setback for the westerly portion of the garage area, as it
relates to the cul-de-sac right-of-way as.shown on Exhibit "A".
