This is to report that the Planning Department has granted
approval of the above mentioned request for a 2-foot partial
encroachment into the side yard of a dwelling, based upon the
following findings:
1. That there are circumstances applicable to the
property's shape and configuration which limit the
ability to develop the site in common with
surrounding properties;
2. That approval of the adjustment will not be
detrimental to the health, safety or general
welfare of the community at large, nor detrimental
to surrounding properties;
3. That the adjustment is consistent with the intent
and purpose of the La Quinta Land Use Ordinance.
Approval for this setback adjustment shall be as shown on
Exhibit A (copy enclosed) as contained in the Planning and
Development Department's file for Setback Adjustment #89-006.
The approval shall be used within one year from the date of
this letter,. otherwise, it shall be null and void, and of no
effect whatsoever. The term "used" shall mean that substantial
construction shall have been completed in reliance.. on the
existing permit.
