Gentlemen:
This is to report that the Planning and ' Development Department
has granted approval of the above mentioned request for a 2-foot
partial encroachment into the side yard of a dwelling, based
upon the following findings:
1. That there are circumstances applicable to the
property's shape and configuration which limit the
ability to develop the site in common with
surrounding properties;
2. That approval of the adjustment will not be
detrimental to the health, 'safety or general welfare
of the community at large, nor detrimental to
surrounding properties;
3. That the adjustment is consistent with the intent
and purpose of the La Quinta Land Use Ordinance.
Approval for this setback adjustment shall be as shown on
Exhibit A as contained in the Planning and Development
Department's file for Setback Adjustment #89-007. The approval
shall be used within one year from the date of this letter;
otherwise, it shall be null and void, and of, no effect
whatsoever. The term "used" shall mean that substantial
construction shall have been completed in reliance on the
existing permit.

SUBJECT: Setback Adjustment 89-007 CC`F 3M
Dear Mr. Hill:
Your application for Setback Adjustment, as shown on attached
Exhibit A, is hereby approved.
The City of La Quinta Planning and Zoning Regulations state the
following:
"9.188.080 Conditions for Setback Adjustment. No
request for a Setback Adjustment shall be granted unless
it is determined that the adjustment is consistent with
the intent and purposes of this title; that there are
special circumstances applicable to the property,
including such factors as size, shape, topography,
location or surroundings that justify the approval of the
adjustment of the setback requirement, and that the
adjustment will not be detrimental to the health, safety
and general welfare of the community or be detrimental to
property in the vicinity of the parcel for which the
adjustment is requested."
In the above case it was found that:
1. The CC and R's for this subdivision identify an
easement over the side yard area of all the lots in favor
of the adjoining owners.

2. The proposed pool is located on a side property,
boundary alongside an easement over the adjoining
property in favor of the future owner of the pool. The
pool is located a minimum distance of three (3) feet from
the neighboring residential unit.
3. This Setback Adjustment is therefore in compliance
with the La Quinta Planning and Zoning Regulations. In
particular, this proposal will not be detrimental to
property in the vicinity of the parcel for which the
adjustment is requested due to the presence of an
easement alongside the proposed Setback Adjustment.
