JUSTIFICATION: No request for a Setback Adjustment shall be granted
unless it is determined that the adjustment is consistent with the
intent and purpose of this Ordinance; that there are special
circumstances applicable to the property, including such factors as
size, shape, topography, location or surroundings that justify the
approval of the adjustment of the setback requirement, and that the
adjustment will be not detrimental to the health, safety, and general
welfare of the community or be detrimental to -property in the vicinity
of the parcel for which the adjustment is requested.

SUBJECT: APPLICATION FOR SETBACK —ADJUSTMENT CASE #89-00.9
Dear Sir:
Your application for an elimination of the rear 5-foot setback
for swimming pools located at 54-007 through 54-555 Southern
Hills in PGA West, is hereby approved. This approval is subject
to compliance with the attached findings and conditions.
FINDINGS:
The City of La Quinta Planning and Zoning Regulations state the
following:
"9.188.050 Conditions for Setback Adjustment. No
request for a Setback Adjustment shall be granted unless
it is determined that the adjustment is consistent with
the intent and purposes of this title; that there are
special circumstances applicable to the property,
including such factors as size, shape, topography,
location or surroundings that justify the approval of the
adjustment of the setback requirement,. and that the
adjustment will not be detrimental to the health, safety
and general welfare of the community or be detrimental to
property in the vicinity of the parcel for which the
adjustment is requested."
In the above case it was found that:
1. The size and shape of the property restricted 'the
placement of the swimming pool and spa; and
2. The rear side of the affected units face onto the golf
course and not onto other dwelling units or buildings.
This setback adjustment will therefore have no detrimental
affect on the surrounding community; and
3. P.G.A. West, the owner of the adjacent golf course, has
stated in a letter that they approve of this setback
adjustment.

CONDITIONS:
The following conditions are attached to the approval of the
Setback Adjustment #89-009.
1. All pool maintenance 'equipment shall be located behind
front, rear and side setbacks.
2. No wall shall be constructed along the rear boundary of
the lot, between the swimming pool and golf course.
3. A 5-foot side setback shall be maintained along the side
of the swimming pool.
4.The swimming pool walls shall be designed to handle any
potential surcharge imposed on it by golf course maintenance
equipment.

Dear Jerry:
This letter will serve as -our approval -for Sunrise Company
to encroach on the 5' setback for the construction and ultimate
use & maintenance of swimming pools next to the golf course
property line in Track 22432-3, phase 1E. As we understand'it-.
the pool would be.built inside,the 5' setback on Sunrise property
giving the pool maintenance,people no where to stand and work to
clean the pools.-- Therefore, we -are in agreement to allow the .
pool maintenance personnel room to work on the pools.
This variance does not.cause-'the golf course,maintenance"or`
use of golf course any problems. -

12. Masonry units shall be Grade N-1 conforming to A.S.T.M. 6%,
and manufactured in accordance with Concrete Masonry
Association Standards.
13. Portland cement shall conform to A.S.T.M. C150.
14. Concrete shall have a minimum compressive strength of 2000
PSI at 2? days.
