SUBJECT: SETBACK ADJUSTMENT-90 01- LOT 8, TRACT 23813
Dear Mr. Peterson:
Your application for a setback adjustment, as shown on the
attached Exhibit "A", is hereby approved.
The City of - La Quinta Planning and Zoning Regulations state - the -
following:
119.188.080 Conditions for Setback Adjustment: No
request for a Setback Adjustment shall be granted unless -
it is determined that the adjustment is consistent with -
the intent and purpose of this -title; that there are
special circumstances applicable to the property,
including such factors as size, shape, topography,
location or surroundings that justify the approval of the
adjustment of the setback requirement, and that the
adjustment will not be detrimental to the health, safety
and general welfare of the community or be detrimental to
property in the vicinity of the parcel for which the
adjustment is requested.
In the above case it was found that:
1. The C,C, & R's for this subdivision identify an easement -
over the side yard area of all the lots in favor of the
joining owners. The proposed pool equipment structure
and outdoor barbecue stand are located on a side property -
boundary alongside this easement.
2. The pool equipment- structure and outdoor -barbecue stand -
are located a minimum distance of three 3-feet from- the -
neighboring residential unit.
3. The proposed pool equipment structure is located two -feet-
away from the rear boundary. The rear side of the lots -
within this tract however; abut open space or golf course --
fairways

4. This setback adjustment is therefore in compliance with
the La Quinta Planning. and Zoning Regulations. In
particular, this proposal will not be detrimental to
property in the vicinity of the parcel for which the
adjustment is requested due to the presence of an
easement alongside the proposed setback adjustment.
