fee of $100 is required when the Application is submitted. Check must

document in his behalf.

JUSTIFICATION: No request for a Setback Adjustment shall be granted
unless it is determined that the adjustment is consistent with the
intent and purpose of this Ordinance; that there are special
circumstances applicable to the property, including such factors as
size, shape, topography, location or surroundings that justify the
approval of the adjustment of the setback requirement, and that the
adjustment will be not detrimental to the health, safety, and general
welfare of the community or be detrimental to property in the vicinity
of the parcel for which the adjustment is requested.

Dear Mr. Gallant:
Your request for a setback adjustment to allow an encroachment
of two feet into a required 10-foot street sideyard for a
chimney chase has' been reviewed and approved based -on the
following determinations:
1.
This adjustment is consistent with the intent
and
-
purpose of the zoning ordinance, in that the
two
foot encroachment affects only a small area
and
still allows an eight. foot clearance for access
along the affected sideyard.
2.
There are special circumstances applicable to
the
property, including such factors as size, shape,
and location that justify approval of
the
adjustment.
3.
This adjustment will not be detrimental to
the
health, safety, and general welfare of'
the
Community, nor will it be detrimental to- property
in the vicinity of the subject parcel.

The following is in reference to your letter of February-13 1990.
Enclosed are two copies of the site plan indicating yard setbacks and
and the location -of the fireplace in relation to the ten footside
yard facing the street Chillon.
Con8aPing to the fireplace in the ten foot offset we extended the
fireplace two feet in lieu of one foot.that is on the approved
plans on record.
I did not.proceed to make this change untill I consulted with
La Quinta Dept. of Planning and Developmentand was informed that
the change was acceptable, where upon,the next phase of inspection
the inspector turn down the change as an invalid change as per
city codes.
Since it was an expensive cost to -make the correction, I requested
for a varience nd asked the Filing Fee to be waivered for reasons
we took reasonable and h`irnest approch with the Dept. of Planning and
Development prior to the change.

The Planning and Development has approved your request for a
waiver of the $100.00 filing fee for a setback adjustment.
Before we can process your request, we will need a site plan
showing the affected area as well as a letter describing the
situation and the circumstances involved. The site. plan must
clearly delineate the request, with two copies required for
submittal.

This letter is -a request to waver the -One Hundred dollar fee that is
normally charged for an applicant " For Set Back Adjustment due to -
misinformation thru the building department office on a two foot
into side yard in lieu of the required one foot set back. This has acurred
on a.street side yard where the set back extends to ten feet.
