JUSTIFICATION: No request for a Setback Adjustment shall be granted
unless it is determined that the adjustment is consistent with the
intent and purpose of this Ordinance; that there are special
circumstances applicable to the property, including such factors as
size, shape, topography, location or surroundings that justify the.
approval of the adjustment of the setback requirement, and that the
adjustment will be not detrimental to the health, safety, and general
welfare of the community or be detrimental to property in the vicinity
of the parcel for which the adjustment is requested.

Dear Mr. Lopez:
Your request for a setback adjustment to allow construction of
a swimming pool with a three foot setback (adjacent to the side
property line) and four foot setback (adjacent to the house)
has been reviewed and the following determined:
1. This adjustment is consistent with the intent and purpose
of the zoning ordinance.
2. There are special circumstances applicable to the
property, including such factors as size, shape, and
location that justify approval of the adjustment.
3. This adjustment will not be detrimental to the health,
safety, and general welfare of the vicinity, provided.all
pool equipment is maintained five feet. from the side
property line and the equipment is enclosed within a
noise -attenuating masonry enclosure.
Therefore, your request is approved subject to the following
conditions:
1. That the pool equipment.shall be a minimum of five feet
from the side property line and shall be enclosed in a
masonry wall enclosure as required by Municipal Code
Section 9.42.050D(5)b.
2. Pool area is enclosed by fencing per State law
requirements.
