Dear Mr..Langston:
Your application for a setback adjustment has been processed.
Your request for a 3-foot pool equipment rear setback has been
denied. However, a 5-foot pool equipment rear setback will be
allowed.
The City of La Quinta Planning and Zoning Regulations state the
following:
9.188.080Conditions for -Setback ._Adjustment. No
request for a Setback Adjustment shall be granted unless
it is determined that the adjustment is consistent with
the intent and purpose of this title; that there are
special circumstances applicable to the property,
including such factors as size, shape, topography,
location or surroundings that justify the approval of the
adjustment will not be detrimental to the health, safety -
and general welfare of the community or be detrimental to
property in the vicinity of the parcel for which the
adjustment is requested.
In the above case it was found that:
1. The subject property does have the following special
circumstance which would support a rear setback
reduction. The rear side of Lot 31, Tract 22982
abuts Dune Palms Road. No other future residents
of surrounding units will therefore be
detrimentally affected by a reduction in the rear
setback for the pool equipment on that lot.
2. The subject property does not have any further
special circumstances relating to size, shape,
topography, location or surroundings further
supporting a setback reduction.

3. The proposed pool equipment will still be 5-feet
from the side boundary in accordance with 'the
existing setback regulations.
4. This Department feels there is no justification for
a 3-foot setback as requested but will approve a
5-foot rear setback for pool equipment. (See,
attached Exhibit A).
5. The above approval of a 5-foot rear setback for
pool equipment on Lot 31, Tract 22982 is consistent
with the intent and purpose of the La Quinta
Planning and Zoning Regulations.
