intent and purpose of this Ordinance; that there are special
circumstances applicable to the property, including such factors as
size, shape, topography, location or surroundings that justify the
approval of the adjustment of the setback requirement, and that the
adjustment will be not detrimental to the health, safety, and general
welfare of the community or be detrimental to property in the vicinity
of the parcel for which the adjustment is requested.

Dear Mr. Langston:
Your request for a setback adjustment to allow construction of
a swimming pool and a three & one-half foot setback (adjacent
to the rear property line) has been reviewed and the following
determined:
1. This adjustment is consistent with the intent and
purpose of the zoning ordinance, in that the area
affected- by the adjustment is not adjacent to any
private property and is adequately fenced.
2. There are special circumstances applicable -to the
property, including such factors as size, shape,
and location that justify approval of the
adjustment.
3. This adjustment will not be detrimental to the
health, safety, and general welfare of the
vicinity, provided all pool equipment is maintained
within the limits of all setbacks from property
lines.
Therefore, your request has been approved subject to
conformance with Exhibit A as provided with the application
(copy enclosed).
