TENTATIVE TRACT 24517 (RANCHO OCOTILLO)
Dear Mr. -Cloutier:
Your request for a setback adjustment for swimming pool
equipment located on the 3 model home units for Tentative Tract
24517 is hereby denied.
The La Quinta Zoning Ordinance states the following regarding
setback adjustments:
9.188.050 Conditions for setback adjustment.
No request for a setback adjustment shall be granted
.unless it is determined that the adjustment is consistent
with the intent and purposes of this title; that there
are special circumstances applicable to the property,
including such factors as size, shape, topography,
location or surroundings that justify the approval of the

adjustment of the setback requirement, and that the
adjustment will not be detrimental to the health, safety
and general welfare of the community or be detrimental to
property' in the vicinity of the parcel for which the
adjustment is requested. (Ord. 5 1(part), 1982: County

After careful consideration it was found that there are no
special circumstances applicable to this property that would
justify a setback adjustment. In particular it was found that:
1. These lots back onto other residential lots and not a
street or public open space.
2. These lots are larger than many other lots in the

Dear Wally;
We respectfully request a setback adjustment allowing us to place
the swimming pool equipment in the rear 5' of the lots on our model
homes. Placing the equipment outside of the set back areas would
severely affect the beauty and function of the backyard. In order
to reduce the noise factor of the pool equipment we have designed
a 6' high block wall around the perimeter and also around the
equipment a 5' wall itself. The result of this modification will
reduce the sound to the neighbors more than the setback. As a side
note it will also negate the necessity of a vault.for the equipment
eliminating a hazard to children downstream.
