This letter.is to report denial of your recent application for
a setback adjustment, pursuant to Chapter 9.188 of the City of
La Quinta Planning & Zoning Regulations. The City's adopted
policy for adjustments for pool equipment is not to allow
deviation from the 5-foot side yard setback requirement because
of the noise problems associated with the equipment and the
affects it can have on .abutting neighbors. The City will
permit an encroachment in the rear yard area if the equipment
is not in close proximity to an existing home. If you should
desire to pursue the rear yard location; the equipment should
be at least 15-feet from the abutting neighbors home.
SETBACK ADJUSTMENT: 2-foot adjustment for pool '
equipment/side yard.
After review it was determined that:
1. This adjustment is not consistent with the intent
and purpose of the zoning ordinance.
2. There are no special circumstances applicable to
the property, including such factors as size, shape,
topography, location or surroundings that justify.
