intent and purpose of this Ordinance; that there are special
circumstances applicable to the property, including such factors as
size, shape, topography, location or surroundings that justify the
approval of the adjustment of the setback requirement, and that the
adjustment will be not detrimental to the health, safety, and general
welfare of the community or be detrimental to property in the vicinity
of the parcel for which the adjustment is requested.

Dear Mr. Yeomans:
This letter is to report approval of your recent application
for a setback adjustment, pursuant to Chapter 9.188 of the City
of La Quinta Planning & Zoning Regulations. The following
setback adjustment has been approved subject to conditions^ and
in accordance with attached Exhibit A..
SETBACK ADJUSTMENT:
+3 foot front yard encroachment (variable setback distance)
FOR: Attached 2 1/2 car garage for a single family home.
CONDITIONS:
1. The attached garage structure shall
not be any
closer than 17-feet to the westerly property line
(see Exhibit A). All other R-2 8,000
.Zoning Code
standards.shall be met.
2. This approval shall expire within 6 months of this
letter unless used in conjunction with
the issuance
of a building permit for the new home.
Thereafter,
the approval shall remain in effect as
long as' the
building permit remains active.
After review it was determined that:
1. This adjustment is consistent with the intent
and purpose
of the Zoning Ordinance.

2. There are special circumstances applicable to the'
property, including such factors as size, shape,
topography,location or surroundings that justify
approval of the adjustment. These special circumstances
are: a) the lot is irregular in shape, 2) the width of
the lot on the north property line is quite -small `
(67-feet) thus hindering the building- setbacks, 3) the
project designer has met all the provisions of the'R-2
8,000 Zone Code except the front yard encroachment, 4)
the applicant has obtained the Homeowner's Associations
approval, as. required, and 5.),the single family: home will
be a benefit to this area.
3. This adjustment will not be detrimental to the health,
safety, and general welfare of the community or be
detrimental to property in the vicinity of the parcel for
which the adjustment is requested.
