pursuant to Chapter 9.188 of the City of La Quinta Planning and Zoning Regulations.

CONDITIONS:
1. The pool shall include reinforcing per the Uniform Building, Code
requirements..
2. The perimeter fence or block wall shall be five feet high (minimum) . -
3. Self -closing gates shall be installed which prevent children from entering the
property, etc.
After review it was determined that:
1. This adjustment is consistent with the intent and purpose of the Zoning.

2. There are special circumstances applicable to the property, including such
factors as size, shape, topography, location or surroundings that justify
approval of the adjustment. These special circumstances are:
a. The lot is' 50' X 100' therefore, the usable rear yard area is
approximately 1450 square feet (30% of the lot) . The pool has been
sited in the rear yard to allow recreational opportunities abutting the
home (e. g. barbecue,. sunbathing,, etc.) and provide pedestrian safety
between the pool and the residence.
b. The public utility companies will not be affected by this action.
3.. This adjustment will not be detrimental to the health, safety, and general
welfare of the community or be detrimental to property in the vicinity of the
parcel for which the adjustment is requested.
