This letter is to report approval of your recent application
for a setback adjustment, pursuant to Chapter 9.188 of the City
of La Quinta Planning & Zoning Regulations. The following
setback adjustment has been approved subject to conditions and
in accordance with attached Exhibit A.
SETBACK ADJUSTMENT:.
Front and side setback of 5-feet reduced to 3-feet.
FOR: Swimming Pool
CONDITIONS:
1. The Applicant shall comply with Municipal fencing
requirements for pools.
2. This setback adjustment does not apply to
mechanical pool equipment.
3. The applicant has obtained the necessary permission
from IID (Exhibit stamped) and GTE (letter
attached) to locate a swimming pool in a'utility
easement. The applicant shall comply with all
stipulated -agency requirements stated by the above.
After review it was determined that:
1. This adjustment is consistent with the intent and
purpose of the zoning ordinance.
2. There are special circumstances applicable to the
property, including such factors as size, shape,
topography, location or surroundings that justify
approval of the adjustment. These special
circumstances are: this is -a small lot with
limited space for a pool.

SUBJECT: ENCROACHMENT WITHIN PUBLIC UTILITY EASEMENT, LOT 21, BLOCK 223
. SANTA CARMELITA AT VALLE LA QUINTA, NO. 21, MB 20/22.
GTE CALIFORNIA, Incorporated maintains a buried distribution facility along the
rear property line at the subject location. The proposed construction of a
swimming pool and associated support structures will encroach within this 5.00
foot PUBLIC UTILITY EASEMENT, as reserved by the above referenced Tract. Our
company, has no objections to the proposed construction, as proposed by American
Pool Construction, or the subsequent encroachment. '
We do request, however, that a three inch (3") PVC conduit, schedule 40 or
better, be placed within the easement area. This would facilitate our accessing
the -area in the future, should the need to replace our facilities arise. This
conduit is to be capped off within five feet (5') of the side property lines,
and should be placed at a minimum depth of thirty inches (30").
