This letter is to report approval of your recent application
for a setback adjustment, pursuant to Chapter 9.188 of the City
of. La Quinta Planning & Zoning Regulations. The following
setback adjustment has been approved subject to .conditions and
in accordance with attached Exhibit A.
SETBACK ADJUSTMENT: 4-foot side yard setback
FOR• Spa
CONDITIONS:
1. A building permit shall, be obtained.
2.' The pool/spa shall be enclosed with a five foot
high fence or wall and include self -closing -gates
to secure the property.
After review it was determined that:
1. This adjustment is consistent with the intent and
purpose of the zoning ordinance.
2. There are special circumstances applicable to the
property, including such factors as size, shape,
topography, location or surroundings that justify
approval of the adjustment. These special
circumstances are: a) The house is located
approximately 10-feet from the rear yard property
line which therefore precludes a pool/spa in the
rear yard, hence a side lard facility is required.
b) The side yard is only 23 feetin width,
therefore, the minimum adjustment is warranted to
allow the spa as proposed. The spa location will
not adversely affect the property owner to the east.
