This letter is to report approval of your recent, application
for a setback adjustment, pursuant to Chapter 9.188 of the City
of La Quinta Planning & Zoning Regulations. The following
setback adjustment has been approved subject to conditions and
in accordance with attached Exhibit A.
SETBACK ADJUSTMENT: one foot into side yard
FOR: Patio Cover
CONDITIONS:
1. The attached structure shall not be any closer than
4-feet to the southerly property line (see Exhibit A).
All other R-1 Zoning Code standards shall be met.
2. This approval shall expire within 6 months of this letter
unless used in conjunction with the issuance of a

building permit for the new structure. Thereafter, the
approval shall remain in effect as long as the building
permit remains active.
After review it was determined that:
1. This adjustment is consistent with the intent and purpose
of the Zoning Ordinance.

2. There are special circumstances_ applicable to the._
property, including such factors as size, shape,
topography, location or surroundings that justify
approval of the adjustment. These special circumstances
are: 1) The concrete decking was poured by the
Applicant's contractor during the. installation of the
existing 'pool,. but the metal straps for the vertical
support columns were not installed correctly, and 2) the
project designer has met all the provisions of the R-1
Zone Code except the side yard encroachment.
3. This adjustment will not be detrimental to the. health,
safety, and general" welfare of the community or' be
detrimental to property in the vicinity of the parcel for
which. the adjustment is requested."
