This letter is to report approval of your recent application
for a setback adjustment, pursuant to Chapter 9.188 of the City
of La Quinta Planning & Zoning Regulations. The following
setback adjustment has been approved subject to conditions and
in accordance with attached Exhibit A.
SETBACK ADJUSTMENT:
Five foot side & rear yard setback reduced to three feet
for the proposed pool and spa.

1. The pool 'and spa shall include reinforcing and be
designed per the Uniform Building Code requirements.

The perimeter block wall shall be five feet high
(minimum).

GTE requires that a three inch (3-inch). PVC conduit,
schedule 40 or better, be placed within the easement

After review it was determined that:
1. This adjustment. is consistent with the intent, and purpose
of the zoning ordinance.
2. There are special circumstances applicable to the
property, including such factors as size, shape,
topography, location or surroundings that justify
approval of the adjustment. These special circumstances
are:
a. The lot is approximately 50-feet x 100-feet
therefore, the usable rear yard area is -very
limited to allow recreational opportunities
abutting the home (e.g. barbecue, sunbathing, etc.i•
and to provide pedestrian safety between the pool
and the -residence.
b. The public utility .companies will not be adversely
affected by this action. Non -opposition approval
from the Imperial Irrigation District is attached.
Staff received verbal confirmation from Mr. Paul
Miller of GTE on February 4, 1992.
3. This adjustment will not be detrimental to ,the health,
safety, and general welfare of the community or be
detrimental to property in the vicinity of the parcel for
which the adjustment is requested.

SANTA CARMELITA AT VALLE LA QUINTA, NO. 1, MB 18/46.
GTE CALIFORNIA, Incorporated maintains an aerial distribution facility along
the rear property line at the subject location. The proposed construction of a
swimming pool -and associated support structures will encroach within this 5.00
foot PUBLIC'UTILITY EASEMENT, as reserved by the above referenced Tract. Our
company has no objections to the proposed construction, or the subsequent
encroachment, as proposed by Mr. and Mrs. Joe Lewis.
We do request, however, that a three inch (3") PVC conduit, schedule 40 or
better, be placed within the easement area. This would facilitate our accessing
the area in the future, should the need to replace our facilities arise. This
