This letter is to report action on your recent application for
a setback adjustment, pursuant to Chapter 9.188 of the City of
La Quinta Planning & Zoning Regulations. The following setback
adjustment has been approved subject to conditions and in
accordance with attached Exhibit A.
SETBACK ADJUSTMENT•
Reduce 5-foot side setback to 2 1/2-feet has been denied.
Reduce 5-foot side setback to 3-feet has been approved.
FOR: Pool & Spa
CONDITIONS:
1. The pool and spa water line shall not be any closer than
3-feet to the existing property line.
2. A 5-foot high perimeter wall shall enclose the pool & spa
and self -closing gates shall be installed at all access
points.
3. A building permit shall be obtained from the Building
Department.
4. The pool and spa shall include reinforcing and be
designed per the Uniform Building Code requirements. .
After review it was determined that:
1. This adjustment is consistent with the intent and purpose
of the zoning ordinance.

2. There are special circumstances applicable to the
property, including such factors as size, shape,
topography, location or surroundings that justify
approval of the adjustment. These special circumstances
are: a) the lot is irregular in shape and has two street
frontages, b) the existing home constraints the shape of
the pool and limits its width to a lap pool, and c) the
property side yard is approximately 10-feet in size.
3. This adjustment will not be detrimental. to the health,
safety, and general welfare of the community or be
detrimental to property in the vicinity of the parcel for
which the adjustment is requested.
