health, safety, and general welfare of the community or be detrimental to

This letter is to report approval of your recent application for a
setback adjustment, pursuant to Chapter 9.188 of the City of La
Quinta Planning & Zoning Regulations. The following setback
adjustment has been approved subject to conditions and in accordance
with attached Exhibits A & B.
SETBACK ADJUSTMENT:
Air -Conditioning condensers in 5-foot side yard area.
FOR: Single Family Home (SR Zoning area)
CONDITIONS:
1. The SR Zoning Code Standards shall be met with the exception
of the above cited modification.
After review it was determined that:
1. This adjustment is consistent with the intent and purpose of
the zoning ordinance.
2. There are special circumstances applicable to the property,
including such factors as size, shape, topography, location or
surroundings that justify approval of the adjustment. These
special circumstances are: a) the existing setback
requirements impose undue standards on the development of the
lot, if imposed; b) public utility. companies will not be
affected by the request, and c) the Fire Department was not
opposed to the units being in the side yard because they will
not affect life/safety provisions (see attached Fire
Department approval).

3. This adjustment will not be detrimental to the health, safety,
and general welfare of the community or be detrimental to
property in the 'vicinity of the parcel for which the
