Dear Mr. Levin:
This letter is to report approval of your recent application for a
setback adjustment, pursuant to Chapter 9.188 of the City of La
Quinta Planning & Zoning Regulations. The following setback
adjustment has been approved subject to conditions and in accordance
with attached Exhibit A.
SETBACK ADJUSTMENT:
20 foot setback reduced to ten feet from existing curb face
FOR: Restroom buildings
CONDITIONS:
1. A building permit shall be obtained from the Building and
Safety Department prior to on -site construction.
2. This setback adjustment shall apply toward the three existing
restroom buildings in the gated community and the fourth one
proposed by this application.
3. All other standards of the Municipal Code shall apply.
After review it was determined that:
1. This adjustment is consistent with the intent and purpose of
the zoning ordinance.
2. There are special circumstances applicable to the property,
including such factors as size, shape, topography, location or
surroundings that justify approval of the adjustment. These
special circumstances are: 1) the project is a private
community and the restrooms will benefit the existing and
future residents, 2) the deviation will not effect health and
safety provisions, 3) no public utilities will be affected by
