JUSTIFICATION: No request for a Setback Adjustment shall be granted
unless it is determined that it is consistent with the intend and purpose
of this Ordinance; that there are special circumstances applicable to the
property, including such factors as size, shape, topography, location or
surroundings that justify the approval of the adjustment of the setback
requirement, and that the adjustment will not be detrimental to the
health, safety, and general -welfare of the community or be detrimental to
property in the area of the parcel for which the adjustment is requested.•

This letter is to report denial of your recent application for a
setback adjustment, pursuant to Chapter 9.188 of the City of La
Quinta Planning & Zoning Regulations.
SETBACK ADJUSTMENT:
Five foot setback reduced to two feet (side yard).
FOR: Air conditioning unit w
After review it was determined that:
1. The lot is large enough to support the installation of the air°
conditioning equipment outside of the setback area of the side
yard of the home.

2. Setback adjustments are to be used for unusual problems to the:
property (e.g. topography, irregular lot size or shape, etc.)
3. This adjustment will be detrimental to the health, safety, and;p
general welfare of the community or be detrimental to property.
