Dear Mr. Roach:
This letter is to report approval of your recent application for a
setback adjustment, pursuant to Chapter 9.188 of the City of La
Quinta Planning & Zoning Regulations. The following setback
adjustment has been approved subject to conditions and in accordance
with attached Exhibit A.
�> SETBACK ADJUSTMENT:
1. Five foot setback reduced to three feet (side yard).
2. Twenty foot setback reduced to eighteen -feet eight -inches
(front yard).
FOR: 1. Swimming Pool 2. Single Family Home
CONDITIONS:
1. The applicant shall comply with Municipal Code Fencing
requirements for pools.
2. Ensure pool is reinforced to Building Code requirements.
3. This setback adjustment does not apply to mechanical pool
equipment.
4. The garage door shall be setback 20 feet from the front yard
property line but the house may be eighteen -feet eight -inches
from the front property line. All other SR Zone Code
Standards shall be met.
f> 5. A building permit shall be issued for any on -site improvements.
After review it was determined that:
1. This adjustment is consistent with the intent and purpose of
the Zoning Ordinance.

2. There are special circumstances applicable to the property,
' including such. factors as size, shape, topography, location or•
surroundings that justify approval of the adjustment. These
special circumstances are: 1) this lot has limited space for a
pool in the side yard and the recreational facilities will not
-; affect any of the existing public utility easements, and 2)
the -buildings plumbing.and form boards were installed on the
property in error based on wrong information on the approved
construction drawings (eg. lot length 131 feet vs. 136 feet).
3. This adjustment will not be detrimental to the health, safety,
and general welfare of the community or be detrimental to
property in the vicinity of the parcel for which the
adjustment is requested. '
