SUBJECT: SETBACK ADJUSTMENT 94-237 (AMENDMENT #1)
Dear Mr. Moore:
On March 24, 1994, we sent a letter to you denying your request to install a second
story balcony on your existing two story home because it encroached into the front
yard setback by approximately four feet. However, pursuant to your verbal request
of March 29, 1994, we will permit the following remodeling work should you desire to
improve the existing appearance of your home.
(1) A covered entry porch can be added to the front of the existing home. The
roof eave and vertical columns can encroach four feet into the front yard
setback.
(2) Architectural plant-ons can be added to the existing two story house provided
they do not exceed more than two feet into the required front yard. For
example, you could add a false balcony to the upstairs bedroom to upgrade the
front elevation provided the railing does not exceed two feet beyond the
surface of the building (Chapter 9.42.050.D.5d; La Quinta Municipal Code).

SUBJECT: SETBACK ADJUSTMENT 94-237
Dear Mr. Moore:
This letter is to report denial of your recent application for a setback adjustment,
pursuant to Chapter 9.188 of the City of La Quinta Planning & Zoning regulations.
Staff cannot approve your request to add a covered balcony onto your existing two
story home extending into the front yard because it would be expanding the existing
non -conforming two story structure. If staff approved the encroachment into the
front yard setback, it would be encouraging other residents to seek administrative
relief from the City's Zoning Code standards.
If you desire to pursue your request further, please file a variance application. The
application form can be picked up at City Hall or mailed upon request. However,
please keep in mind if you file the request you are required to prove that your
request merits approval due to either a hardship in the configuration of the property
boundaries (i.e. lot irregularity), or the strict application of the Zoning Ordinance
deprives your property of priveleges enjoyed by other properties in the vicinity.
The Planning Commission, in reviewing a variance request, must review whether or
not the granting of the variance would be a special privilege (Government Code
Section 65906) .
