Dear Mr. Remick:
The Community Development. Department has reviewed your request for a setback
reduction from five feet to three feet for the proposed fountain and swimming pool depicted
in Exhibit "A". Your application has been approved pursuant to Chapter 9.188 of the City
of La Quinta Planning and Zoning. regulations. 'This approval is subject to the following
conditions and in accordance with the attached. Exhibit "A".
SETBACK_ ADJUSTMENT:
Reduction of side yard setback from five feet. to three feet.
FOR: Swimming Pool and Fountain
CONDITIONS:
1. Obtain a building permit for the pool from the Building Department.
2. The fencing requirements of the R-2 Zone shall be met in conjunction with the State
requirements for pool fencing.
FINDINGS: .
1. This adjustment is consistent with the intent and purpose of the Zoning Ordinance. .
2. There are special circumstances applicable to the property, including such factors as
size, shape, topography, location or surroundings .that justify approval of the
adjustment. These special circumstances are the shape of the lot.

(4) Take Notice that California Pools IS NOT RESPONSIBLE for: Underground conditions or objects,
and any Damage to'curbs, sidewalks, driveways, lawns, or other items in access area
