of this Ordinance; -that there are special circumstances applicable to the

SUBJECT: SETBACK ADJUSTMENT 95-346 (RV PARKING SPACE)

Dear Mr. Franges:
Our department has reviewed your application for consideration of a setback adjustment to
install a new concrete driveway to park a recreational vehicle within 15" of the side property
line. Your request is not subject to the provisions of the City's Setback Adjustment
provisions of Section 9.160.050 of the Municipal Code because the three-foot parking
setback provision listed in the Off -Street Parking Code was established for multi -family or
commercial land uses with parking lots instead of single family homes.
We would like to inform you that this type .of improvement is governed by the rules and
regulations of Tract 25290 and the recorded CC and R's for this site. The CC and R's are
agreements between all tract property owners and are part of the purchaser's legal title.
The CC and R's specify that accessory vehicles can be kept on the site provided they are not
visible from the street. Therefore, the property owner should work with Century Homes
(the tract developer) to modify the existing CC and R's to either encourage or prohibit RV
parking in the tract boundaries by updating the existing provisions of the CC and R's. We
will refund the filing fee paid to. our office- on September 14 since no action was taken.
