On October 16, 1995, we sent you a letter notifying you that we could not approve your
request to reduce your side yard building setback on Calle Monterey to less than ten feet..,
This letter was mailed to your attention and transmitted to the Building and Safety
Department. However, your contractor was inadvertently allowed to pour the concrete slab'
for your home although we denied your request. Therefore, based on this misunderstanding, ;.
our department will permit you to continue work on the home.based on plans that ;are on ;
file with our Building and Safety Department.

REF: 53-260 AVENIDA MADERO (AT CALLE MONTEREY)
Dear Mr. Cox:
Our department has reviewed your application request to adjust the exterior sideyard
building setback on Calle Monterey for your house. In the application you explain that the
Building Department approved the plans although the parkway dimension was shown
incorrectly (i.e., 10-feet instead of 12-feet). Therefore, your house is being built too close
to the exterior side property line. Mr. Danny Crawford, Building Inspector, issued a
correction notice concerning this problem on October 16th.
Pursuant to Chapter 9.188 (Setback Adjustments and Temporary Use of Land) of the
Zoning Code, the City .can consider adjustments in front, side and rear setbacks if special
circumstances to the property exist and the health, safety and general welfare of the
community can be met. Consequently, we find that:
1. It is the applicant's responsibility to insure that all City requirements are being
met during any on -site construction work. This includes both building and
safety concerns, and engineering related improvements during any on -site
construction,
2. Financial considerations cannot be used as a reason to justify approval of an
adjustment request;
3. Adjustments are allowed if there are problems with the lot that do not
provide the same development advantages as abutting sites. This includes lots
that are irregular in size or have topographic problems. This site -is
rectangular and is not impacted by any unusual problems; and,
4. The approved site plan did show correct setbacks as measured from the
property lines.

misunderstanding that occurred with your plan check application.

Today I received the attached setback adjustment request. The building department issued
a building permit for this case I believe last month (we approved plans on 9-18). The
developer has started to construct the home (plumbing is in w/o slab), however, they have
realized that the house is 8-feet from Calle Monterey instead of 10-feet. The reason being
is that the parkway width is 10-feet vs. 12-feet. The building inspectors informed the
owner/developer of the problem in the field this morning. See Attached. Therefore, the
owner would like an adjustment because he thought the plans were correct since we approved
them. The applicant spoke with Mark Harold about this plan check problem, but Mark
stated "he does not review off -site notes."
