Dear Applicant:
On February 1, 1996, the Community Development Department received your application
request, on behalf of Century Homes, to adjust the side yard setback from 5-feet to 2.5-feet
for pool equipment at 47-880 Via Nice. We cannot approve the request because it exceeds
our policy of allowing a 20% deviation of the existing Zoning Code (9.32) regulations and
the equipment can be placed in the rear yard without any problems. Since this is an
administrative action by the Community Development Director, you may appeal this action
to the Planning Commission on forms provided by our department. The appeal fee is
$175:00 and shall be filed on or before February 16th.
