LOCATION: 47-880. VIA NICE (LAKE LA QUINTA)
Dear Mr. Cleaves:
This letter is to report denial of the setback adjustment application to reduce the side yard setback
from 5-feet to 3-feet for an A.C. condensing unit for a new house being built at Lake La Quinta
pursuant to Chapter 9.188 of the Municipal Zoning Code regulations. The- Community
Development Department has determined that:
L This adjustment is not consistent with the intent and purpose of the Zoning Ordinance
in that locating the condensing unit within the five-foot side yard will affect
pedestrian and/or emergency personnel access from the front yard to the back yard.
2. There are no special circumstances applicable to the property, including such factors
as size, shape, topography, location or surroundings that justify approval of the
adjustment. The house builder should have designed the house to comply with
Chapter 9.32 (R-1) of the Municipal Code which requires a five-foot side yard for
mechanical equipment. No special circumstances exist to permit the encroachment.
3. This adjustment will be detrimental to the health, safety, and general. welfare of the
community because it reduces the width of the passageway between the house and the
existing wall to less than 5-feet for emergency access.
