JUSTIFICATION: No request for a Setback 'Adjustment shall be granted
unless it is determined that it is consistent.with the intend and purpose
of this Ordinance; that there are special circumstances applicable to the -
property, including such factors as -size, shape, topography, location or
surroundings that justify the approval of the adjustment of the setback
requirement, and that the adjustment will not be detrimental to, the
health, safety, and general welfare of the community or be detrimental to
property in the area of the parcel for which the adjustment is requested.

Dear Mr. Weber:
This letter is to report approval of the setback adjustment application pursuant to Chapter 9.188 of
the City of La Quinta Planning and Zoning regulations, subject to Conditions and according to the
attached exhibits.
SETBACK ADJUSTMENT REQUEST: To reduce a portion of the front yard setback from 20-
feet to 16-feet for a new house (i..e., patio cover and master bath encroachment).
CONDITIONS:
A. Obtain a building permit from the Building & Safety Department by >kwaffir 3,
41.-1or this permit will expire..
The City shall approve a property adjustment application (i.e., Lot Line Adjustment
or Parcel Merger) before permit issuance..
After review it was determined that:
1. This adjustment is consistent with the intent and purpose of the Zoning Ordinance to
allow development of single family houses in an S-R District. There are special
circumstances applicable to this property, such as its irregular shape (i.e., triangular
shape), that justifies approval of the adjustment. Development of irregular shaped
properties with a house and pool is more difficult than rectangular shaped lots. A 20-
f6ot wide sewer easement abuts the east property line further limiting the buildable
area of the lot(s). The orientation of the house has been situated on the lot to take
advantage of the views of the Santa Rosa Mountains and is consistent in design with
other irregularly shaped developed parcels along Avenida Montezuma that have.also
