LOCATION: 44425 FRONTERRA (QUINTERRA)
Dear Sirs:
This letter is to report denial of the setback adjustment application to reduce the side yard setbacks
(i.e., from 5-feet to 3-feet for a private spa and to 1-foot for the mechanical equipment) for a house
in Quinterra pursuant to Chapter.9.188 of the Municipal Zoning Code regulations. The Community
Development Department has determined that:
1. This adjustment is not consistent with the intent and purpose of the Zoning Ordinance in that
locating the spa and/or mechanical equipment within the five-foot side yard will affect
pedestrian and/or emergency personnel access from the front yard to the back yard:
2. There are no special circumstances applicable.to the property, including such factors as size,
shape, topography, location or surroundings that justify approval of the adjustment. The rear
area of the lot is irregularly shaped, however, the accessory improvements can be located in
the rear yard to comply with Chapter 9.32 (R-1) of the Municipal Code which requires a five-
foot side yard for mechanical equipment and spas. No special circumstances exist to permit
the encroachment.
3. This adjustment will be detrimental to the health, safety, and general welfare of the
community because it reduces the width of the passageway between the house and the
existing wall to less than 5-feet for emergency access and unnecessary because the
improvements can be adequately placed without an adjustment.
