of this Ordinance; that there are special circumstances applicable to the

surroundings that justify the approval of the adjustment of the setback
requirement, and that the adjustment will not be detrimental to the
health, safety, and general welfare of the community or be detrimental to
property in the area of the parcel for which the adjustment is requested.

This letter is to report approval of the setback adjustment application pursuant to Chapter 9.188 of
the City of La Quinta Planning and Zoning regulations,' subject to Conditions and according to the
attached exhibits. = '
SETBACK ADJUSTMENT REQUEST: To reduce the building separation between the main
residence and the guest house from 6-feet to 5'-4".
CONDITIONS: Before building permit issuance for the guest house, the property owner shall file
a Plot. Plan application with our Department. The filing fee is $75.00. Besides the application; the.
property owner shall provide a copy of the existing Grant Deed so that a covenant agreement can be,
prepared that restricts the use of the guest house according to Chapter 9.32 of the Zoning Code.
Once the covenant is prepared, we require that the owner have the agreement notarized and returned
to staff for recordation with the County of Riverside Recorder's Office., When mailed for
recordation, a building permit can be obtained.
After review it was determined that: `
1. This adjustment is consistent with the intent and purpose of the Zoning Ordinance to
allow development of single family houses with guest houses in an R=1 District...
There are special circumstances applicable to this property, such as its irregular shape,
that justifies approval of the adjustment. Development of irregular shaped properties
with a house and guest house is more difficult than rectangular shaped' lots. -The -
orientation of the house has been situated on the lot to take advantage of the views
of the Santa Rosa Mountains and existing lake in the gated development. The
architectural design of the guest house -is consistent with the main dwelling. A

trellised breezeway between the house and the guest house is necessary for fire safety
needs and in case of an emergency (i.e.; site accessibility).
2. This adjustment will not be detrimental to the health, safety, and general welfaie of
'the community because the distance between structures is greater than 5'-0" which
provides adequate.access for safety personnel in case of an emergency.
