Dear Mr. Hampton:
This letter is to report approval of the setback adjustment application pursuant to Chapter 9.188 of
the City of La Quinta Planning and Zoning regulations, subject to Conditions and according to the
attached exhibits.

A. To reduce the rear and side yard setbacks from 5' to 3' for a private swimming pool.
B. To reduce the rear and side yard setbacks from 10' and 5' to 4' and 3' for the pool equipment.

A. Obtain a building permit from the Building & SafetyDepartment;
B. The existing fence enclosing the proposed pool shall be five-foot high (or higher) and
have self -closing gates; and
C. The pool equipment shall be placed a minimum distance of five -feet from the side and
rear- yard property lines.
After review it was determined that:
1. 'This adjustment is consistent with the intent and purpose of the Zoning Ordinance to
allow development of single family houses and swimming pools in an S-R District.
2. There are special circumstances applicable to the property, including such factors as
size, shape, topography, location or surroundings that justify approval of the

adjustment are: (1.) that•the private rear yard area,is small, and (2) greater separation
is needed between the house and,swimming pool to provide adequate space for a
f ' future patio cover and walking surfaces around the pool for the "occupants and/or
guests..
3. This adjustment will not be detrimental to the health, safety, and general welfare of.,
the community because the rear yard'improvements will be privately maintained and
fenced to prohibit access to the improvements unless by the owner's permission. The
pool equipment will be placed five -feet away from adjacent property, lines to eluninate
future noise impacts the equipment may have on adjacent neighbors.
