JUSTIFICATION: No request for a Setback Adjustment shall be granted
unless it is determined that it is consistent with the intend and purpose
of this Ordinance; that there are special circumstances applicable to the
property, including such factors as size, shape, topography, location or
surroundings that justify the approval of the adjustment of the setback
requirement, and that the adjustment will not be detrimental to the
health, safety, and general welfare of the community or be detrimental to
property in the area of the parcel for which the adjustment is requested.

This letter is to report approval of the subject setback adjustment application pursuant to
Chapter 9.188 of the City of La Quinta Planning and Zoning regulations, subject to
Conditions and according to the attached Exhibit A as approved
SETBACK ADJUSTMENT REQUEST:
To reduce the street -side yard setback from.10 feet to 8 feet for a private attached patio
cover.
CONDITIONS:
1. Obtain the necessary building permit(s) from the Building and Safety'
Department for the patio cover, and,
2. As shown on Exhibit A, support posts for the patio cover shalt maintain a
minimum of eight (8) feet from the subject property line. The patio cover may
cantilever out from the posts, but must maintain minimum distance from the
property line as is specified in the Uniform Building Code (UBC).
After review it was determined that:
1. This adjustment is consistent with the intent and purpose of the Zoning

SR Zoning District.

2. There are special circumstances applicable to the property, including such
factors as size, shape, topography, location and/or surroundings that justify
approval of the adjustment, in that the side yard area is adjacent to a street,
requiring an increased setback which restricts the ability to utilize or improve
the available yard area in relation to the residential structure. '
3. This adjustment will not be detrimental to the health, safety, and general
welfare of the community because the yard improvements will be privately
maintained, and are currently fenced to prohibit access to the improvements
unless by the owner's permission, and will be situated in the street side yard
area so as to be less obtrusive on surrounding properties. Adequate area exists
behind the street curb to maintain sight visibility for traffic purposes.
