SUBJECT: MINOR ADJUSTMENT 96-436
LOCATION: 54-775 AVENIDA ALVARADO
Dear Mr. Lockard:
The Community Development Department has reviewed your request to convert the existing carport
into a garage pursuant to Section 9.210.040 (Minor Adjustments) of the Zoning Ordinance. We find
that we can approve the request provided the following Conditions are met:
1. The garage .door shall be located 18-feet from the property line and the inside dimension of
the new garage shall be 20' by 20'. To accomplish this interior depth dimension, the existing
partition wall creating the storage area at the back of the existing carport shall be modified
unless determined by the Building and Safety Department to be a structural element of the
house.
2. A sectional, roll -up garage door shall be installed.
3. The Community Development Department shall approve the final construction plans prior to
building permit issuance.
4. Obtain a building permit from the Building & Safety Department for this project by February
14, 1997. Otherwise, this approval shall expire and be of no use unless extended by this
Department.
After review it was determined that:
1. No impact to the City's General Plar. will occur with this adjustment request because the
Land Use Element designates the site for residential purposes. This minor adjustment is
consistent with the intent and purpose of the RC District to enclose the carport and provide
a two -car garage for the existing house.
2. The project is exempt from the provisions of the California Environmental Quality Act
(CEQA) under Section 15303(e) which allows the conversion of small accessory structures
into carports or garages.

3. There are special circumstances applicable to the property, including such factors as size,
shape, topography, location or surroundings that justify approval of the adjustment. Those
circumstances are the carport/trellis structure is an existing improvement on the property, and
the garage door will not be closer than 18'-0" to the property line.
4. This minor adjustment will not be detrimental to the health, safety, and general welfare of this
area of the City because there are other. existing structures in the La Quinta Cove which the
County of Riverside approved that are similar in nature to this request. The proposed garage
structure will lessen the visual blight that occurs with open carport structures which are
adjacent to public streets because stored materials (i.e., vehicles, storage, etc.) will now be
concealed behind the new garage door.

Besides Mr. Lockard's minor adjustment application to convert his carport to a garage, he would also.
like to enclose the trellised porch facing Calle Portrero. Under the new RC District provisions, Calle
Portrero would be the shorter of the two property lines making it the front yard setback unless
otherwise determined by the Director if the property lines are similar in length.. In this,case, the `-
property lines are 100' and 170' (i.e., merged parcels). Do we want to,permit this conversion?:
P.S. - Under the old SR provisions, we permitted -this application request.

The bank is in foreclosure on this property with the current owner. The applicant, Mr.
Lockard, is negotiating to buy the house from the bank; he would like a window of
opportunity in which to close the deal and obtain a building permit to complete his Phase
#1 improvements to the existing house.

This letter is to report approval of the setback adjustment application pursuant to Chapter 9.188 of
the City of La Quinta Planning and Zoning regulations, subject to Conditions and according to the
attached exhibits.
SETBACK ADJUSTMENT REQUEST: To convert an existing carport/trellis structure into a
garage with building setback of 16' (instead of 20') to the property line.
CONDITIONS: 1. Obtain a building permit from the Building & Safety Department for
this project by January 5, 1997. Otherwise, this approval shall expire
and be of no use. .
