Recommended by: F068 REV -4 2/01 TRACTS REQUIRING ON -LOT RETENTION The La Quinta Municipal Code (LQMC) Section 13.24.110(J) currently allows subdividers to employ the drainage concept of "on -lot" retention of storm.water if the lot is larger than 2.5 acres. Prior to the current ordinance language, subdividers were allowed to employ the "on -lot' drainage concept on smaller lots. The following list identifies the tracts where individual lot owners are required to retain all drainage on their lot per the conditions of approval for that tract. Tract 26524 - The Estancias Tract 26769 - Mountain View Estates Note: La Quinta Polo Estates (Tracts 14104 north of canal, 21176 south of canal) was subdivided prior to being annexed into the City. These tracts do not have common area retention basins, nor are the individual landowners required by the conditions of approval to retain drainage on their lot. However, individual landowners could, be held liable for claims of damage in a civil suit, if drainage from one lot damages the property/improvements on'a neighbors lot. City staff should mention this liability aspect to proposed builders in La Quinta Polo Estates and encourage the use of on -lot retention. But, in this case, the City can not require the use on -lot retention in these two tracts.
