ITEM TITLE: Election of Chairperson
RECOMMENDATION:
Elect one member to serve as Chairperson for the Cultural Arts Commission.
BACKGROUND AND OVERVIEW:
A Chairperson for the Commission is selected to preside over the meetings. An open
vote will be taken at the Commission meeting to select a Chairperson.
Voting Procedures:
All actions must be taken on a majority vote or by a majority of the quorum present.
On the passage of every motion, the vote shall be taken by voice or roll call as
appropriate. Staff will open and close nominations to the Commission for Chairperson.
The vote will be taken and the Chairperson will be elected.
Tie Votes:
In the case of a tie vote, an additional motion is made which obtains a majority vote
to break the tie. If a tie vote results at a time when less than all members are present,
the matter shall automatically be continued to the Agenda of the next regular meeting,
unless otherwise ordered by the body.
ALTERNATIVES:
The alternatives available to the Commission are:
1. Elect one member to serve as Chairperson for the Cultural Arts
Commission; or

CULTURAL ARTS COMMISSION MEETING
DATE: July 26, 2001
ITEM TITLE: Point Happy Art Work
RECOMMENDATION:
As deemed appropriate by the Cultural Arts Commission.
BACKGROUND AND OVERVIEW:
The developers of the Point Happy project, which is located on the northwest corner
of Washington and Hwy. 1 1 1, would like to include an art piece in the center of their
project.
Ms. Valerie Miller is representing the developer regarding the art piece and attended
the June 21 Commission meeting to provide additional information regarding the
proposal. The Point Happy project will pay approximately $10,000 towards the Art
in Public Places fund for the entire project.
After some discussion, the Commission recommended that Ms. Miller provide the
following information at the July 26 meeting:
Provide a drawing of the art piece in relationship to the setting
Provide an alternate design for the water feature, not necessarily round
Provide an alternate to the poured concrete pool for the water feature: perhaps
incorporate native rock from the area into the basin
Provide areas for benches
Ms. Miller has provided information regarding the modifications requested by the
Commission. These are provided as Attachment A. Ms. Miller has stated that the
cost of the project is approximately $85,000.
Once the Commission has reviewed the proposal, the Commission's recommendation
will be forwarded for City Council consideration.

The alternatives available to the Commission are:
1. Approve the Point Happy art work as submitted and recommend that the
City Council approve the piece and allocate up to $85,000 from the Art
in Public Places fund; or
2. Approve the Point Happy art work with modifications and recommend
that the City Council approve the piece and allocate up to $85,000 from
the Art in Public Places fund; or
3. Do not approve the Point Happy art work; or
4. Provide staff with alternate direction.

Public Art Meeting- July 26, 2001
Items for consideration:
❑ Presentation of new site more acceptable for viewing and enjoying the art
❑ New collaborative artist enlisted for fountain and environmental art
❑ Presentation of his work and submission of proposed sketches utilizing new
site.
This procedure is being followed as a result of last meeting where Felicia's bronze
work was approved but the fountain aspect and pool was found lacking. I've stated
the concerns which are now being addressed.
Concerns made by committee at June meeting:
❑ Placement of the fountain/sculpture: You as a committee wanted the art work to
be able to be experienced. You hoped people could sit or walk near the fountain
and enjoy the work.
❑ Majority of the committee felt the pool part of the sculpture was too commercial
and not integrated to the sculpture. A few of you suggested a more irregular
shape with use of stone... possible fake stone. It was suggested that if the
sculpture was in some other location it could even have a meandering stream.
Suggestion was that we have other ideas and sketches
❑ Committee definitely wanted the art accessible.
❑ Discussion that the sculpture could be located off center.
All of these issues are being addressed and my presentation will be incorporating these
ideas. Felicia's work will remain much the same with possible modification if necessary
after fountain and environmental art is approved.

CULTURAL ARTS COMMISSION MEETING
DATE: July 26, 2001
ITEM TITLE: Friends of the La Quinta Senior Center Request
RECOMMENDATION:
As deemed appropriate by the Cultural Arts Commission.
BACKGROUND AND OVERVIEW:
The Friends of the La Quinta Senior Center (Friends) would like to have a mural painted
on the back wall of the stage of the Senior Center as provided by Attachment A. The
City Council considered the Friends request at the June 19, 2001 City Council meeting
and concurred that this matter be referred to the Cultural Arts Commission. Staff

Center. The perfect place would be the back of the stage and would serve
as a back -drop for the many programs presented there.

Foundation regarding a known muralist and they have recommended a
local artist. The Foundation was also very interested in this project and
suggested that we use some of our talented local high school students to

The City Council referred this request to the Cultural Arts Commission for review and
recommendation. The next Cultural Arts Commission meeting will be Thursday, July 26, 2001
at 7:00 p.m. in the Study Session Room of City Hall.
In order to provide the Cultural Arts Commissioners ample information for consideration, I will
need to receive information regarding this project by July 10, so it can included in the Cultural
Arts Commission packets. The information that will be needed is a description of the art work,

from the local high school could be involved in this painting. Was told
that this could be done. As for an artist name, we should have it by the
Cultural Arts Commission's meeting on July 26, 2001.
COMPLETION DATE: Would like the Mural to be finished by the next Friends
open house meeting on Dec. 1, 2001.
COST: Would be covered by both the Arts Foundation and the Friends of the
La Quinta Senior Center.

TEMPORARY DONATION
AND
ACCEPTANCE AGREEMENT
This Temporary Donation and Acceptance Agreement (the "Agreement") is entered into this
day of 2001, by and between the City of La Quinta ("City") and
("Artist ").
WHEREAS, the City wishes to accept and the Artist wishes to donate on a temporary basis
an artwork more fully described in Exhibit "A" attached hereto and incorporated herein by this
reference; and,
WHEREAS, the City desires to increase public awareness and exposure to the arts in a cost
effective manner for the general welfare and benefit of the City's residents; and,
WHEREAS, the Artist is interested in making the temporary donation to the City to be
displayed at the City's discretion.
NOW, THEREFORE, the parties hereto agree as follows:
1. The City shall accept the temporary donation of the artwork described in Exhibit "A" for a
period of
2. Artist agrees that the City shall have sole and absolute determination as to the location and
placement of the artwork. In the event Artist does not approve of the proposed location this
Agreement may be canceled.
3. All transportation and installation, costs for display at the City's identified location shall
be -borne by the Artist. All plans and installations for the artwork shall be approved by the
appropriate City and/or other government officials.
4. Artist shall provide City with written instructions for appropriate maintenance and
preservation of the artwork and shall either provide such service to the City or provide
sufficient funds to provide for that service during the period of the donation.
5. Artist agrees that the entire risk of loss or damage to the artwork is borne by the Artist
throughout the entire period of the donation as well as installation and removal costs. Artist
shall provide for all insurance covering the risk of loss or damage to the artwork.
6. In the event that the City determines, at its sole discretion, that it no longer desires to display
the artwork, then this Agreement may be terminated upon a thirty (30) days notice and the
artwork shall be removed by the Artist at no cost to City within twenty-one (21) days of the
Notice of Termination by the City. City shall have the right to dispose of any artwork which
has not been removed pursuant to the Notice under this paragraph, or within 30 days after

the expiration of the donation period where no early termination notice is provided. Such
failure to remove the artwork shall be deemed to transfer the temporary donation into a
permanent donation with the City obtaining full title to the artwork.
7. The Artist shall retain all rights under the Copyright Act of 1976, 17 U.S.C. Sections 101
et sea., and all other rights in and to the Artwork except ownership and possession, except
as such rights are limited by this Agreement.
8. A plaque identifying the Artist and/or artist shall be installed and maintained near the
artwork, by the City.
9. This Agreement, consisting of pages and _ exhibits, embodies the entire Agreement
and understanding between the parties hereto, and there are no other agreements and
understandings, oral or written, with reference to the subject matter hereof that are not
merged herein and superseded hereby, except as set forth hereinabove.
10. No alteration, change or modification of the terms of the Agreement shall be valid unless
made in writing and signed by each party hereto and approved by appropriate action of the
City.
11. No waiver of performance by either party shall be construed as or operate as a waiver of any
subsequent default of any terms, covenants and conditions of this Agreement.
12. This Agreement, regardless of where executed or performed, shall be governed by and
construed in accordance with the laws of the State of California.
13. In addition to any other rights or remedies and subject to the restrictions otherwise set forth
in this Agreement, either party may institute legal action to seek specific performance of the
terms of this Agreement, to recover damages, or to obtain any other remedy, at law or in
equity, consistent with the purpose of this Agreement. Such legal actions must be instituted
in the Superior Court of the County of Riverside, in an appropriate Riverside County
municipal court, or in the Federal District Court in the district of California which includes
Riverside County.
14. If any party to this Agreement brings a legal action or proceeding against another party to
enforce the provisions of this Agreement, or on account of a claim or dispute arising out of
this Agreement, then the prevailing party in such arbitration or legal action or proceeding
shall be entitled to reimbursement by the other party of the legal fees and costs, including
reasonable attorney fees, incurred by the prevailing party in connection with the legal action
or proceeding.
15. This Agreement shall be binding upon and shall inure to the benefit of the City and the
Artist, and their respective heirs, personal representatives, successors and permitted assigns.
16. All notices, requests, demands and other communications which are required or permitted

RECOMMENDATION:

BACKGROUND AND OVERVIEW:
At the November 12, 1998 Cultural Arts Commission meeting, the Commission
discussed an existing list of locations for Temporary Art throughout the City as
provided in Attachment A. The Commissioners visited each site and were asked to
prioritize locations for placement of Temporary Art when an artist participates in the
Temporary Art Program.
Attachment B is the existing list of locations for the placement of Temporary Art.
The Cultural Arts Commission may wish to revise the list of locations for Temporary
Art placement and prioritize the locations. Another option available to the Commission
is to recommend a location for Temporary Art placement based upon the piece of art
work. By selecting a location based upon the size and scale of the piece, the
Commission is providing greater flexibility in selecting a location rather than working
from a list of prioritized locations.

Commissioner Vossler ask9who is responsible for the art wall in ity Hall. Staff indicated that the
Community Services Department was. Commissioner Vossler then suggested sending a letter of
commendation to the school on display after the art work is taken down. Chairperson Hull will do a letter.
The Commission discussed the need for the Art in Public Places Master Plan since there is no longer an
Art in Public Places Commission. Staff informed the Commission that the Plan is needed due to funds
being collected for public art. Commissioner Chappie and Chairperson Hull will review and update the
Master Plan if needed and bring it back to the Commission for review at a later date.
C. Discussion of Art Placement
The Commission discussed various locations for placement of art in La Quinta including the grass area
at the west end of Francis Hack Park, the La Quinta Historical Museum, and the Veterinarian Hospital.
Commissioner Shamis gave a brief history on the priority list the APP Commission made and suggestec
everyone go out in cars to the sites and to establish a current priority list. It was moved by Commissioner
Benay/Reynolds to research Adams Street Park as a site for public art. Unanimous.
Staff will check with the Community Development Department for the priority list which the APP
Commission had established. Commissioner Vossler asked if "old land" could be used and suggested that
the corner of Washington and Eisenhower be considered as a location for public art.
D. Discussion of Temporary Art Contract
It was moved by Commissioner Welch/Benay to continue this item to the next agenda. Unanimous
E. Authorize Expenditure for Pages in Winter/Spring Brochure
Staff informed the Commission that the amount estimated for 10,000 4-page, glossy color photos of a!!
public art locations in La Quinta that would be inserted into the Community Services Department
Winter/Spring Recreation Brochure would be approximately $2,000 which was higher then originall;
reported. The Chamber of Commerce will also include the information in the La Quinta Newsletter. Cost
of the insert would come from Art in Public Places Operating funds. The Commission is responsible for
doing the write up and taking photos of the art and bringing it to the Community Services Department by
December 1". Commissioner Vossler will ask Wayne Gardner to take the photos, and Commissioner
Chappie will do the artist letter and information on the art pieces.

It is a pleasure to serve as the staff person to the Cultural Arts Commission. In order to be the most
effective at our meetings, I would request that you review your Commission Packet sent to you the
Friday before the Thursday Commission meeting. If you do not receive your Commission packet
by Tuesday's mail, please leave a message on Terri's voice mail at 777-7090 and we will get a
packet to you by Wednesday.

If at any time you have a question or concern regarding the Community Services Department,
