SUBJECT: TEMPORARY USE PERMIT 2008-830; SIGN APPLICATION 2008-1285
2nd ANNUAL LA QUINTA ARTS FOUNDATION' BLUES, BREWS, AND BBQ
Dear Ms. Hughes:
The Planning Department has reviewed and has enthusiastically approved your request to
hold the 2"d annual "Blues, Brews,. and Barbeque" event, located at 77-865 Avenida
Montezuma within the Village at La Quinta. The approval of the events is granted under
Section 9.100.140 of the La Quinta Zoning Code and -'is subject to the. following Findings
and Conditions:
FINDINGS:
1. The events will not be detrimental to'the health, 'safety and general welfare of
the community in the area of the proposed event. The Fire Marshal has given
clearance regarding access and circulation within the proposed event area.
2. There is adequate area to conduct the events and to accommodate the
anticipated attendance, provided all conditions of approval and the approved site
plan are complied with.
3. Sufficientparking will be provided for the anticipated attendance.
4. Public roadways providing access to the events. are capable of accommodating
the anticipated traffic volumes in a reasonable and safe manner with minimal
disruption to local traffic circulation.
CONDITIONS:
1. The applicant agrees to indemnify, defend and hold harmless the City of La
Quinta in the event of any legal claim or litigation arising out of the City's
approval of this project. The City of La Quinta shall have the right to select its
defense counsel in its sole discretion.

2. The event shall be held from 11:00 a.m. to 6:00 p.m., on Saturday November
1,. 2008. Equipment setup -and set-up for Barbeq"ue. vendors may begin at 7:00
a.m. on October 31, 2008; the Friday before the event. All equipment must be
removed, and site restored to prior conditions,. before. 4:00 p.m. on the Sunday
evening concluding the event. '
3. You are granted a waiver to Sections 11.04.030; 12.28.040 and 12.28.130 of
the La Quinta Municipal Code for October 31, 2008 only. All overnight parking
shall be contained within the enclosed baseball' diamond at the La Quinta
Community Park and its parking areas. No overnight parking is permitted within
City owned parking lots or within the residential areas surrounding the park.
Contact the Sheriffs Department regarding overnight security and patrol.
4. All vendors shall obtain a City Business License. The serving of food and
alcoholic, beverages during the event shall be subject to the rules and
requiremnts of the Riverside County Health Department and State of California
Alcoholic Beverage Control, respectively. The applicant shall provide the City
with proof of ABC approval prior to the event.
5. The applicant shall obtain all other applicable permits, if required, from the
appropriate agencies (i.e. Fire Department, Sheriffs Department, etc.).
6. Permits for any temporary structures (e.g. tents exceeding 200 square feet
and/or canopies exceeding 400 square feet), stages or open flame devices shall
be obtained prior to their installation. Prior to the event set-up, please contact
the La Quinta Building and Safety Department and Riverside County Fire Safety
at 863-8886, Planning and Engineering, for any additional requirements of the
Fire Marshal. Fire lanes shall be established and/or maintained during the event.
7. The use of amplified equipment for music presentations is permitted, provided
that all provisions of the City of La Quinta's Noise Ordinance (LQMC 9.100.210)
are complied with.
8. If portable generators are used for electricity, they shall be shielded to prevent
accidental contact with guests. If extension cords are used., they shall be
ground -secured to prevent tripping.
9. Roadways, parking areas, and pedestrian traffic aisles to other businesses and
activities in the vicinity shall be maintained accessible at all times.
10. Certain areas providing access to the event area are public and, as such, general
public access may not be denied or restricted in any manner that extends
beyond the limits of this event as approved.

11. Tents shall be located within the enclosed baseball diamond. No more than two
(2) tents shall be 1ocated outside of the baseball diamond. A 20 -foot access way,
shall be maintained at all times along Avenida Montezuma and Calle Montezuma.'
The use of street barricades is. prohibited. The approved site- plan shall be
complied with.
12. Security personnel shall be easily, identifiable to the public by the provision of
uniformed personnel. All designated private security personnel must be licensed
by the State of California and possess a valid.Private Security license.
13. Fire extinguishers shall be placed in a noticeable location between every three
tents within the event.
14. Temporary trash receptacles shall be provided in and, around the event areas. All
event areas shall be left free of debris at the end of each day's activities, and
after the event concludes.
15. The applicant shall conform to the City of La Quinta Large Venue and Event
Waste Management Plan for waste and recycling coordination. Burrtec Waste
and Recycling Services can be contact at (760) 340-2113. -
16. An adequate number of ,portable rest room facilities shall be provided, to
accommodate participants and guests. ADA -compliant' portable restrooms shall
be provided as required by the Building and Safety Department.
17. Approvals of signs for this event are limited to those applied for and approved
under Sign Application 2008-1285.
18. Three changeable message signs. are permitted along Washington Street and .
Calle Tampico as part of this Temporary Use Permit and Sign Application 2008-
1285. The location and messages on the signs shall comply, with the approved
Sign Application on file with the Planning Department (SA 2008-1285). The
signs are permitted only between the dates of October 30, 2008 and Saturday
November 1, 2008, and shall be removed on Saturday at the conclusion of the
event. An encroachment permit shall be. obtained prior to the installation of
signs, please consult the Public Works Department (760) 777-7078.
19. The site shall be left clean and in its original manner at the . conclusion of the
event. Trash receptacles shall be provided so that trash/debris can be deposited
accordingly.
20. All applicable permits shall be obtained from the California Department of
Alcohol Beverage Control (ABC) prior to the event;. all conditions of approval
issued by the ABC shall be complied with.

21. The applicant shall obtain an encroachment permit with the City of La Quinta
Public Works Department for any off-site directional signs placed in the City's
right of way, and for any traffic controls placed within the City's right of ways.
Traffic control plans shall be submitted along with the encroachment permit for
City approval.
22. You are required to schedule a site walk-through with the Fire Marshall,
Riverside County Health Department and a City staff member for the morning of
Saturday, November 1, .2008. The meeting shall take place prior to the day's
activities.
Adherence to these conditions as outlined will ensure that adverse impacts to surrounding
properties and businesses will be minimized. The City may elect to add conditions to this
application to mitigate any problems that arise not previously addressed herein.
