SUBJECT: TENNIS COURT LIGHTS
ISSUES:
To update the Commission as to the status of repair of tennis courts 1-4 lighting.
SUMMARY:
The City Council awarded a bid for the repair of Fritz Burns Park Tennis Courts 1-4
lighting at the Council's December 7, 1993 meeting. AZ -Tech Electric, the firm
selected to perform the repairs, began work on December 27, 1993.
As of January 6, 1994, work was progressing as expected. The site labor for AZ -Tech
Electric indicated that the work would be completed on Wednesday, January 12, 1994.
The official completion date was to be Saturday, January 15, 1994.
FISCAL IMPLICATIONS:
The original contract amount was $18,598.96.

IMARY:
Maloney, Inc. completed the Master Plan for Fritz Burns Park in October, 1992. The Master
broke the total development into four phases. The current City budget contains funding for
,truction documents and actual construction of Phase One within the 1993-94 Capital
ovement section of the budget.
Inc. was selected for construction documents and construction management services at the
ember 7, 1993 Council meeting (Attachment A). As part of the Agreement between BSI, Inc.
the City, we are to conduct one public forum. This forum, unlike previous design forums, is r
pportunity to rearrange the configuration of the existing Master Plan design, but rather a final
)rtunity for selected individuals to provide information and suggestions for refinement of the

November 23, 1993, the Assistant City Manager, City Engineer, and the Parks and Recrea

The Selection Committee consisting of Mayor Pro-Tem Sniff, Council Member Bangerter
the Assistant City Manager, Public Works Director and Parks and Recreation Director
interviewed two firms on Monday, November 8, 1993, for the purpose of choosing a fir
to prepare construction documents, and provide construction administrative and
inspection services. The two firms interviewed were BSI, Inc. and Purkiss Rose/RSI.
Following the scoring of the firms' presentations and proposals, it was determined by
the Selection Committee that BSI, Inc. was the most qualified firm to provide the
required services. The next step in the process is to review/negotiate BSI, Inc.'s
proposed fee. Upon conclusion of negotiations, staff will return to the Council at its
first meeting in December with an agreement for services.
FISCAL IMPLICATIONS:
A total of $368,744 is budgeted in Fiscal Year 1993-94 for Fritz Burns Park Phase One
contract/design services, and the BSI, Inc. cost estimate is $398,000.

(c) it has carefully considered how the work should be performed. and (d) it fully understands
facilities, difficulties and restrictions attending perfurmance of the work under this Agreement.
Should the C.tmsultant discover any latent or unknown conditions materially differing from the:
inhercnr in the work or as representrttl by the City, it shall immediately inform City of such fai
and shall not proceed except at Cunsultant's risk until written instructions are received from di

relieve Comuitant from any obligatinn to correct any incomplete, tnaccuralc or detective work

1.7 Control Over Conetmctton Site. During Phase I -our, Construction
Services for the duration of construction of the site improvements, Consultant shall have no
Control over or charge of. and shall not be responsible for superintendence of construction
processes, site conditions, operations, equipment, personnel, or safety.
1.8 Additional Se:rvitrs. In accordance with the terms and conditions of this
Agreement. the Consultant shall perform services in addition trt those specified in the Scope of
Services (Exhibit "A") when directed in writing to do sn by the Contract Officer, provided that
Consultant shall not be required to perform any additional services without eompen%ation. Any
addition in compensation not exceeding five pereeet (5%) of the Contract Start may be approved
by the Contract Officer. Any greater increase must be approved by the City Council.
1.9 Additional Timeixtcnsion During Cunsimctinn. The Construction

2.2 h&&od of Payment. Any month in which Consultant wishes to receive
pavment, Consultant shall submit to the City no later than the tenth (loth) working day of such
month, in the torm approved by the rity's Finance Director, an invoice for services rendered
prier to the date of the invoice. Such invoice shall (1) describe in detail the services provided,
including time and matertais, (Z) npccify c4oh staff member whet has provided services and the
number of hours assigned to each such staff member, and (1) indicate the total expenditures to
data. Such invoice shall contain a certification by a principal member of Consultant specifying
that the payment requested is for work performed in accordance With the terms of this
Agreement. City will pay Consultant for all expenses stated thereon which arc approved by City
pursuant to this Agreement no later than thu last working day of this nuoetth.

Agreement.

3.4 Term. Unless earlier terminated in accordance with Section 7.8 of this
Agreement, this Agreement shall continue in frill force and effect until completion of the servicw
except as otherwise provided in the schedule of Performance (Exhibit "U").

5.3 Remedies. In addition to any other remedies the City may have if
Consultant. falls to pruvide or maintain any insurance policies or policy endursemems to the

9.1 No is . Any notice, demand, request, consent, approval, communication
either party desires or is required to give to the other party or any other person shall be in
writing and either served personally or sent by prepaid, first-class mail to the address set forth
below. Either party may change its address by notifying the other party of the change of address

SCOPE OF SERVICE
The BSI team proposes the following Scope of Services based on the Request fo
Proposal and City staff clarifications. The BSI team has also included a few items withii
the Scope of Services which were not specifically requested but could be required ii
order to comply with all local regulations for a park project such as Fritz Bums Park
We have identified those elements within this category. The following Scope of Service;
has been prepared based on the four different phases: Design Development, Construction
Documentation Preparation, Bidding and Negotiations, and finally, Construction Services
Phase One - Design Development
Task 1 - Base Information
BSI will meet with City staff to collect base information and scaled preliminary master
planned drawings, refine the Scope of Work, and set the schedule for completion.
Task 2 - On -Site Field Investigation
The BSI team will review all on -site base information and visually field verify the
existing and proposed improvements of the preliminary master plan.
Task 3 - Base Maps
The BSI surveyors will prepare a base map for the entire site at a scale of 1" = 20'-0",
with one foot contours, and will be prepared on 24"x36" sheets. This base informatior
will be digitized for computer generated working drawings. All existing utilities and
easements will also be plotted on these final base maps.
Task 4 - Geotechnical Soils Report
The BSI team will coordinate the preparation of a geotechnical soils report for the entire
site. This report will be prepared by M&T Agra and will provide recommendations for
all phases of construction. The following items will be evaluated:
1. Geological conditions which could impact site development.
2. Suitability of excavated materials for use as fill.
3. Excavatability of materials.
4. Shrink/swell factors in estimating quantities.
5. The necessity for, and extent of, remedial grading prior to earthwork and
construction.
6. Building foundation design.

There will be ten test borings at varying depths. The following tests will be performe
Insitu density and moisture content, direct shear, expansion index, corrosivity, st
classification, and R-value. The following recommendations will be provided.

2. Temporary and permanent cut and fill slopes.
3. Excavatability of materials in the planned pool areas.
4. Subgrade preparation prior to earthwork, pool, and building construction.
5. Earthwork recommendations.
6. Suitability of on -site materials for use as fill.
7. Shrink/swell factors.
8. Corrosivity of site soils.
9. Pavement structural sections.
10. Allowable bearing pressures for proposed structures.
11. Equivalent fluid pressures for pool wall design for level final grade.
12. Soil expansion index.
13. Site seismicity and potential for liquefaction.

Task 5 - Public Input for Design Development
The method and process for developing public input is different than that of t
preliminary design. The public input at this phase will be held at a single meeting. T
BSI team will invite various users from both the local City of La Quinta and t
Coachella Valley. These groups will include organizers of children's and senior
groups, the disabled community, and potential maintenance personnel. A list will
formed from input of City staff and various BSI team member contacts. The input w
be solicited in the format of questionnaires, and one-on-one discussions. Questions w
range from appropriate size lockers to programming needs and requirements.
The input from this first meeting will be summarized and a list of potential participar
will be formed. It is the intent to follow-up this meeting, as required, with phone ca
to those participants who could provide the team with more specific input and feedbai
during the duration of the design development process.
Once this information has been received by the BSI team, a synopsis of input will
prepared and presented to City staff for their review and authorization to begin t
preparation of the design development documents.
Task 6 - Utility Review and Building Code Requirements
Simultaneously, the BSI team will begin contacting the various agency and Ci
departments to determine code requirements, restrictions, and availability of vario
utilities needed for the site. BSI will mail utility letters, make phone calls, and meet,
necessary, each agency to determine early in the process if a conflict exists, therel
avoiding delays in the future.
Task 7 - Preparation of Preliminary Design Development Documents
The BSI team will prepare preliminary plans for the development of Phase Oi
improvements. The preliminary plans shall include the following:
Revised Site Plan - Based on the input received from City staff and the publ
input meeting, prepare a new Phase One refined site plan to scale. This revise
site plan will be the beginning of a working drawing base map.
Revised Architectural Documents - The team will prepare preliminary plans i
the following architectural elements:
Aquatics Building - 3,700 square feet which could include restrooms wii
vandal resistant fixtures, showers, changing areas, offices, and storage ar
maintenance/janitorial area.
Pool Apparatus Storage Building - Approximately 500 square feet whit
could include secure storage for pool apparatus and miscellaneous

equipment. This building would not contain plumbing fixtures and/
heating and air conditioning system. Mechanical ventilation would
provided.
Pool Equipment and Service Building - Approximately 500 square fc
which could include secure storage for pool mechanical equipment, Li
heaters, filters, pumps, and chlorination components; provide for wa
and drainage hook-ups; and coordination with the pool engineer. TI
building would not include heating or air conditioning. Mechanic
ventilation would be provided.
Shade Structure for the Pool Area Bleachers (approximately 1,200 sqw
feet).
Shade Structure for the Children's Wading Pool Area (approximat
1,500 square feet).
Task 8 - Presentation to City Staff
The BSI team will present the preliminary design development concept to City staff
their review and approval to proceed with the preparation of the final design developm
documents.
Below is a list of documents to be submitted to City staff for their review. A total
five copies will be submitted to City staff. Each of these documents will be revised
updated based on the input received above.
Landscape Architecture and Site Planning Documentation - The finalized base n
will be prepared to reflect all hardscape patterns, site furnishing locations, and layout
tot lot area.
A list of all site furnishings and related catalog cuts will also be submitted.
The BSI team will prepare a list of potential irrigation equipment and types of heads
be used in the development of the park. A preliminary planting plan will also
prepared describing the selection of plant material to be used and the specific locat
of all trees. The plan will identify size, location, and approximate quantity.
Architectural Documentation - Finalized floor plans and elevations of the aquae
building, pool equipment and apparatus storage building, and the shade structures sl
be rendered and colored for presentation purposes. In addition, outline specificatil
will give general description for structural, mechanical, and electrical components in
building and related catalog cuts.
Electrical, Water, and Gas - The information for preliminary utility meter locations
connections with Imperial Irrigation District, Southern California Edison, and South
California Gas will be incorporated into the preliminary grading plan.

Pool Design - Design development documents will be provided indicating the locati(
of lane line arrangements, storage, guard stand placement, depth of pool, pool sli(
arrangement and access, and an identification and sizing of all related pool utility line
i.e., water and filter lines, pool electrical, etc.
Civil Documentation - Design development documents will include a preliminai
grading plan. This plan will identify property line and easements, grading, parking 1
and striping configuration, existing and proposed location of storm drain lines, propose
retaining walls, drain line and basin locations, and all existing utilities. Additionally, tl
BSI team will prepare a preliminary drainage study for the entire park site using the Cis
drainage design standards. BSI has talked to City engineering staff and they ha)
indicated that the existing systems are not sized for the park drainage (60" in Old Avem
52 and 66" in New Avenue 52). The drainage study will be for the park site only ar
will provide recommendations for Phase One only. Based on the limited undergroun
facilities, the park drainage system could outlet at the northeast comer of the park si
adjacent to the 66" pipe on New Avenue 52. A hydrology study of the park site usin
the modified rational method and the latest mapping provided by the City will be use(
The City shall also provide copies of the drainage studies for the surroundin
improvements. A preliminary earthwork analysis will also be prepared based on
balanced grading plan concept.
Materials and Research - Design development documents will include the preparatio
of an Outline Specifications Manual identifying the quality and criteria standards for a
non -catalog cut items, materials, and products to be used on the site or in th
construction of the buildings or pool facilities.
Project Development Schedule - Preparation of an updated schedule for the completio
of the project.
Statement of Probable Construction Costs - A preliminary estimate of probabl
construction costs for Phase One will be prepared based on the refined desig
development documents. This estimate will be itemized in sufficient detail to full
evaluate the financial impact of all construction items relative to Phase One improvemer
costs including all Phase One buildings, pools, and related site improvements.

Composite Utility Plan - Plan will indicate all utilities that will be located on the Ph,

utilities at the site are adequate and that no utility design outside the park site will
required. Sewer, gas, water, electrical, and telephone will come from one of
adjoining streets.)
Horizontal Control - Plan will locate all hardscape and building elements us.

elevations, and architectural details.
Mechanical Plans - Plans will include mechanical floor plan, mechanical roof plan
equipment schedule, and mechanical details.
Structural Plans - Plans will include foundation plans, roof framing plans, buildin,
sections, structural details, and structural calculations.
Plumbing Plans - Plans will include plumbing floor plans, plumbing roof plans, fixtur
schedules, isometric diagrams, and plumbing details.
Pool Construction Plans - Plans will include plan view of pools, sections and details
structural sections of the pools, reinforcement schedules, mechanical drawings for thi
pool's filtration system, booster pumps, chemical control systems, and required electrica
drawings.
Irrigation Plan - Plan will include all Phase One irrigation with provisions for futun
phases of construction, all legends and callouts, provisions for future reclaimed water i
required, all heads, mainline, and provisions for connection to the City's Rainbirc
Maxicom System.
Planting Plans - Plans will include all location, size, and quantity of trees, shrubs, an(
ground covers located within the Phase One construction area.
Temporary Erosion Control Plan - Plan will indicate, on a screened grading plan, the
location of all sand bags and related erosion control devices.
NPDES Document - This is an optional service that could be required by the State of
California. This document incorporates information from the proposed planting plan anc
grading plan to isolate all potential contaminants that may be present, and could

potentially enter the storm drainage system during construction. This effort entails
report and the preparation of a plan. BSI will complete the preparation of all form
The City, as Agency, must sign and submit them to the state.
The BSI team will prepare a complete set of contract documents, bid forms, ar
technical specifications. The specifications will include the following: Notice Invitil
Bids, Instructions to Bidders, Proposal Forms, Contract Agreement, General Provision
and Special Provisions. All specifications will be prepared using the BSI Green Boa
format.
The BSI team will prepare a finalized estimate of probable construction costs. TI
estimate will be based on the final Phase One working drawings and will be itemiza
using industry standards and the latest costs from the most recently constructed projecl
Task 1 - The BSI team will prepare a 50% complete set of construction documents bass
on the approved Phase One design development documents. These plans will inclu
outlines of legends, notes, listing of details, etc., and a refined estimate of probat
construction costs reflecting any changes that have occurred since the estimate prepar
in the design development phase. BSI will submit 5 sets of plans and specifications
City staff for their review and comment. Additionally, BSI will send a preliminary
to each of the utility agencies to identify any service or conflicts anticipated. (Allow ti
weeks for City review.)
Task 2 - The BSI team will meet with the City to review the comments and then bel
to incorporate the comments into the 90% construction documents. All plans a
specifications will be significantly complete and the estimate of probable constructi
costs will be revised again to include and incorporate any items added to the fii
concept, i.e., material changes, quantities, layout or depth changes, etc. BSI will subr

Task 3 - The BSI team will incorporate the final City comments and preliminary util
information into the final 100% complete set of construction documents. T

specifications for final City review and approval. Simultaneously, BSI will submi
100% complete set of plans to each affected utility and required approving agency

Task 4 - BSI will incorporate the approving agency comments into the final docume
and present the final construction documents, specifications, bid form, and enginee
estimate of probable construction costs to the City for approval to advertise for bids
Phase Three - Bidding and Negotiations
The BSI team will supply a list of bidders to be used in the distribution of plans s

City, answer all questions, and follow-up with any necessary addenda clarifications. A

BSI will evaluate alternatives or substitutions proposed by the Contractor after th
bidding process and prior to the execution of a contract with the successful Contractor

bids, and making a recommendation of the award of contract.
Phase Four - Construction Services
The BSI team proposes to provide both construction administration/landscape architectur
field review and continuous construction inspection during the entire length of th
construction process. Keith Rattay will serve as the construction administrator an
provide periodic field review, and Larry Cobb will provide continuous inspectio
services. Each of these services has been described in detail below.
Construction Administration/Landscape Architecture Field Review
This service is based on the length of anticipated construction to be 100 working day
at 10 hours per week for a 20 week period for a total of 200 hours and 30 hours c
clerical. The construction administration/landscape architectural field review will includ
the following:
Weekly site meetings with the Contractor, City, and Inspector.
Preparation of weekly minutes of these meetings and their distribution.
Preparation of all change orders and related graphics for City review am
approval.
- Review and/or coordination of the review and approval of all produc
submittals and maintain a master file to be turned over to the City.
- Review and/or coordination of the review of all shop drawings.
- Negotiation of all change orders with the Contractor on behalf of the City
- Provide all plan clarifications to the Contractor.
- Participation in the final walk-thru.
Participation in two intermediate walk-thrus during the maintenanct
establishment period.
Distribution of all documentation to City staff, Contractor, and BS:
Inspector.

Continuous Construction Inspection
The estimate for construction inspection is based on a construction period of 100 workir
days. Larry Cobb, a qualified public works and landscape inspector, will provi<
services for 6 hours a day, for 25 days, over a period of 20 weeks with 2 follow-i
inspections during the maintenance period. The construction inspection services inclut
the following:
Familiarization with and review of contract documents.
- Monitoring compliance with applicable laws, regulations, ai
specifications.
- Participation in pre -construction meetings. Attendance at other meetiq
and conferences as required.
- Coordination and review of compliance certificate, shop drawings, etc
- Daily inspection and preparation of daily inspection log.
- Review and recommendation in the processing of payment request
review and verify quantities.
- Assistance in the recommendation in processing change orders.
Preparation of periodic project status reports.
Coordination with Contractor, Agency staff, etc.
Coordination of materials testing, both in the laboratory and on-si
review of test results.
- Monitor materials used for compliance with the plans and specificatiol
- Conduct interviews of Contractor's employees to verify compliance w
wage rates.
- Develop punch list.
- Review items requiring corrective action with the Contractor and subs
final acceptance report when corrections have been made.

Total hours as indicated are based on the estimated time requirements as determined b
the plans and specifications. Invoicing of fees will be based on the level of effo
actually required to properly administer and inspect the project. If the level of effort'
less than the estimate, the City will be billed accordingly. Should additional services b
required to accomplish project objectives, said services will be billed in accordance wit
the rate established in the Fee Section (under separate cover).

1. The Consultant shall procure and provide to the City professional errors and
omissions liability insurance in the amount of $1,000,000.00.
2. All required insurance forms, as required by the City of the Consultant, shall be

CONSIDERRTIONS FOR LR QUINTR CITY POOL
In considering the running of a multi -faceted aquatic program at this facility it will
need to be designed for efficiency and productivity. The ideal pool can house a
multitude of programs such as swimming lessons, classes for the physically
challenged, swim team practices and competitions, lap swimming, synchronized
swimming and aqua aerobics. There are a few key elements for each of the
programs needs to be met. They are as follows:
Swimming lessons and classes for the physically challenged: An entrance
with steps (or a graded entrance) to make the child, adult or physically challenge
individual feel comfortable and in control of their environment is necessary. A
teaching pool where the depth ranges from 3-5 feet is usually ideal.
Aqua aerobics: The above mentioned instructional area would serve well for
aqua aerobics. However it is ideal to also have a deep area, of at least 7 feet,
adjoining the shallow area in order to include a deep water aerobic portion during
the class.
Synchronized swimming: My knowledge in this area is limited. I do know that
in order to teach synchronized swimming effectively the pool needs to have a
section that is at least 9 feet in depth.

SUMMARY:
At the December 13, 1993 meeting, the Commission discussed the BMX track issue,
the Work Plan, and the City Council/Community Services Commission joint meeting.
Chairman Best requested that the Work Plan be placed on a future agenda for the
Commission's review/discussion prior to meeting with Council.
FISCAL IMPLICATIONS:
None.
RECOMMENDATION:
Staff recommends the Commission review the Work Plan, and make any final changes
desired in preparation for the joint meeting with the City Council on January 24, 1994.

The first Work Plan of the Community Services Commission represents three months
of development, review, and revision. It is the hope of the Commission and staff that
the Work Plan will serve as a tool for setting priorities and providing direction.
The Commission divided the Assignments according to whether the item was an
existing or potential assignments, and prioritized the Assignments as follows:

Suggestions for Improvement. The Commission believes that this Assignment has
been performed very well. Commissioners could
become better educated and informed regarding
parks and recreation programs, and facilities
development and construction processes
Expansion of Assignment. Address ramifications of Professional Services
selection process, and its effect on the
Commission's role in park development.

Commitment Required: Commitment falls under regular meetings, except
for interviewing and scoring RFQ's/RFP's, which
require 5-7 hours per incident.

Commission feels that it performed well
in selecting park design firms, and in conducting

SUBJECT: JOINT MEETING OF COMMUNITY SERVICES COMMISSION
AND CITY COUNCIL
ISSUE:
To convey the date for the joint meeting with City Council.
SUMMARY:
Staff presented a Departmental Report at the December 21, 1993 City Council
meeting. The report focused on the joint meeting date of January 15, 1994 suggested
by the Commission. The Council recommended that the Commission consider
January 24, 1994, which is the Community Services Commission's second regularly
scheduled meeting of January.
The format would be similar to the one discussed previously:
6-7 P.M. The Council and Commission would meet separately to discuss
the issues of the evening.
7-8 P.M. The Council and Commission would meet together in the Council
Chambers to discuss three issues:
1. The Commission's recommendation regarding the
Cultural Affairs Commission
2. The future status of the CSC
3. The proposed Work Plan of the Commission
8-9 P.M. The joint meeting would conclude, with an opportunity for each
body to reconvene separately to discuss and summarize the joint
meeting dialogue.
