Storage type water heaters and storage and backup tanks for solar water heating systems shall be -externally wrapped with insulation having an installed thermal resistance of R-12 or greater. Internal insulation can be included in the combined insulation level only where the R -value of such insulation has been labelled on the tank exterior by the manufacturer. This blanket requirement applies to storage tanks used primarily for domestic water heating systems. It does not apply to storage tanks used primarily for space heating systems or to solar storage tanks mounted outdoors and:directly exposed to weather. Piping in unconditioned space leading to and from water heaters must be insulated with at least R-3 insulation for the first 5 feet of pipe closest to the water heater, or whatever 'shorter length is'in uncondi- tioned space,. It is not necessary to' penetrate a fire wall with the pipe insulation. The 12 -hour program dial reads 6 -NOON -6 on a light* . background for daytime hours, and 6-12-6 on a dark background for nighttime hours. When the clock is set to the correct time, the time indicator (Fig. 11) must point to the corresponding day (light) or night (dark) portion of the program dial. PROGRAM SETTING The program dial is a clock with 12 hour day -night scales for adjustable program pins. The program pins change thermostat control from one temperature lever to the other temperature lever at set times. The pins may be used in sets; such as, a blue low temperature or set- back pin followed by a red high temperature pin. The blue pin puts the blue temperature lever in control, the red pin puts the red temperature lever in control. The pins can be located at half-hour intervals on the program dial, but there must be at least one hour between any 2 pins. The minimum setback or setup period is one hour. The programmer has been set at the factory to lower the temperature at 10 PM (blue .pin), and to raise the temperature at 6 AM (red pin). The pins can be changed and additional setback periods added with the 2 extra sets of pins in the clock cover. To remove a pin, press against program dial and pull the pin straight out. To replace, push the, pin into the selected notch until fully seated. Do not attempt to change a pin if it is engaged with the program index. When inserting the pins, use the 12 -hour clock scales around the program dial. Times for pin placement are the same as for clock setting, above. FOR EXAMPLE A second setback period is desired starting at 8 AM and ending at 4:30 PM. To start, the setback, a blue pin is inserted at the 8 on the light (day) part of the scale. To end the setback, a red pin is inserted in a notch between the 4 and 5 on the daytime scale. A window on the front of the thermostat tells which temperature lever is controlling the temperature. •A blue circle, indicates a blue. pin has put the blue' lever in con- tro1..A red circle indicates: the red pin has'returned tem- perature control to the red lever. MANUAL PROGRAM ADVANCE BUTTON This button allows manually starting a program, or bypassing the next programmed temperature change by pressing the button in completely. If the button is fully depressed during temperature control by the blue lever, temperature control will change to the red temperature lever. Based on available County permits, it appears this project is essentially in the same.stage today as it was in March, 1977. ` 2. Permit History: The County of Riverside issued Permit No. 286299 to Noel Jensen and Marilyn Knapp on November 19, 1976. This permit authorized construction of 1369 -square -foot, single-family residence with 184 -square -foot porch and 687 - square -foot garage. The permit was expired on April 3, 1978 and records do not indicate whether any inspections were performed. 11 A supplemental permit for plumbing modifications within the garage was issued on March 16, 1977. The Permit No. is 290563. This permit was also expired on April 3, 1978.The City of La Quinta has issued two permits for the subject property. Permit No. 114 allows.the construction of 225 -lineal -feet of six -foot - high wall. Permit No. 115 authorizes .the installation of a temporary power pole. These permits were issued on May 14, 1983. Records do not indicate that inspections were performed and the permits are...considered to be expired. 3. Previous Abatement Action: On December 15, 1982, a complaint was received concerning the abandoned garage structure. On December 16, 1982, a letter was sent to Marilyn Knapp and Noel Jensen requesting them to contact the City concerning this matter. The letter was returned on December,22, 1982, noted as undeliverable. As follow-up to the original complaint, the Jensens were notified by Certified Mail sent on April 11, 1983, that the,inconplete.structure was considered a public nuisance and that action should be taken within thirty .(30) days to resume con- struction or.remove the structure. This letter was returned in early May, unclaimed. On May. -11,.1983, a "Notice of Pendency of Administrative Proceedings" against the subject property was recorded, with Riverside County Recorder's Office. On November 16, 1983, a Notice of Withdrawal of this matter was recorded. The file does not indicate any action between those dates. In January, 1984, contact with Riverside County Building and Safety Office indicated that there was a valid permit for the dwelling and garage structures. The County had apparently extended this permit to February of 1984. The City's Chief Building Inspector requested that this extension be rescinded. On February 10, the City and the Jensens were advised by the County Department, of Building and Safety that the second extension of the permit had been issued in error and was therefore rescinded. STAFF REPORT - CITY COUNCIL November 20, 1984 Page 2. On February 22,,.1984, the City sent a letter to Mr. Jensen advising that the permit had expired and instructing that all construction cease until.plans have been submitted and a new permit issued. This Certified Letter was returned unclaimed. 4. Current Abatement -Action: On.September. 10, 198.4; the Community Development Departrment.reinstituted.abatement proceedings advising the Jensen that they did not have'a current -permit and that their options were either to complete the project,.including.securing a new permit or to remove.all structures from the premises. This Certified letter .was picked up by the Applicant on September 14, 1984. Since'no response was received,.an additional Certified letter was sent on September.28, 1984, advising the Applicant that the property had been posted as a Public Nuisance. On October 10, 1984, the City received a letter from Noel Jensen.indicating that they were ready to start construction as soon as they were granted a building permit. The letter noted that construction .could. begin as soon as their current home was sold and.indicated that this had been done -and they were now looking for a.rental to move into in the area. On.Octcber 12, 1984, the City again advised the Jensen that ,they had not responded to previous notices con- cerning the Public Nuisance .posting and that any action.on their part to appeal this action must be in writing. On October 15, 1984, the City Council reviewed a request from Fred and,Kay Wolff•concerning.the status of this matter. On approxi - .mately -October 24, 1984, Mr -and Mrs. Jensen submitted a letter appealing the posting of their property as a Public Nuisance,.indicating that the project could be completed in the fall of 1985 or sooner and that they had rented a house in the area on a short -tern agreement. 5. Applicable Ordinances: Chapter.11.72 of the La Quinta Municipal, Code entitled Public.Nuisances sets forth.definitions and procedures concerning hearing and abatement of -public nuisances. Within that section, violations of the Uniform Building Code and the Uniform Housing Code are defined as public nuisances. Among other things, the Uniform.Housing Code specifies that a substandard building, is a nuisance and that a substandard building is one in which certain conditions might exist to .an extent. -that life, limb, health, property safety or welfare of the general public could be.adversely affected: These conditions include, but°are not limited .to,.inadequate sanitation, structural hazards, hazardous wiring, hazardous plumbing,.hazardous mechanical equipment,'faulty weather protection,, fire hazard, faulty construction material; hazardous or unsanitary premises, inadequate maintenance, inadequate exits, and improper occupancy: Since the structure.is.only.partially completed and has been.exposed to the weather for a considerable period of time, it is evident that it falls within the criteria of a substandard building. Since the Applicant has not secured a permit -since the last one.expired.in December of 1983, it.is'also not possible to alter -,the condition of the building to.bring it into a standard condition. After conducting this hearing, the,City Council,_ifthey.agree that,.the.subject premises is, in fact, -a public nuisance,may authorize its abatemeit.directing the owner to accomplish.the abatement or the City. In the event that the City conducts the abatement,,all charges and costs associated therewith may be, upon completion of certain procedures,placed as a lien against the property. STAFF -REPORT - CITY COUNCIL Novenber' 20, 1984 Page 3. 1. STAFF COMP EiVTS AND ANALYSIS There seems little dcxabt that these premises can be determined a public nuisance as defined in the La Quinta Municipal Code, the Uniform Building Code and the Uniform Housing Code. The principal indicators to -support this determination includer ° The garage'structure is only partially completed and does not currently have an active permit. ° The long period of time that has occurred since any progress has subjected the existing incomplete structure to weathering and deterioration. ° The project, from all outward appearances, has been abandoned by.the owner and .frequently such abandoned structures serve as an attractive nuisance. ° The incomplete nature of the structure creates a negative, visual impact to the surrounding neighborhood and could adversely affect those property values. ° Little or no effort has been made by the Applicant to resolve any of,the above conditions. Based on the.above, a nuisance condition can•be easily documented and all existing improvements could be abated as set forth•in the La Quinta Municipal Code. This type of situation frequently occurs when structures are built using cut -of - pocket, money or other limited revenues and when they are constructed, by owner/-'. builders on a weekend or other infrequent basis. It is not uncommon -for such projects to take on the appearance of.abandonment and otherwise take inordinate lengths of time to complete.. It is evident from the record and visual observation, of the site that appropriate action needs to be taken to remedy the existing condi- tion. . On the one hand, it seems that the Applicant has made little effort in the.past to resolve these conditions. The original permit for both the dwelling.and a garage is more than eight years old and, to date, only the garage is partially complete. Records would indicate that the condition of the site has changed little since March, 1977, although there was apparently some maintenance effort and chainlink fencing within the last .year or so.. It is because of this past history that Staff questions current statements from the Applicant that the project will now be completed in a timely manner and. while the most desirable situation would be to assure that proposed improvements are constructed and constructed in a timely manner, there is'nevertheless hesitation :in simply issuing.a permit and allowing the construction to proceed in a, routine manner. Essentially, the question before us, atthis. point in'time, is to.determine whether or not.all existing improvements should -be abated on the basis of a. public nuisance determination, or whether or,not the Applicant should be given one last opportunity to complete the project. It would seem that.the past history of the project would only warrant the latter alternative in the event that.the Applicant can demonstrate in a substantive manner that financial resources are now available to assure his ability to complete the structure in'a timely manner. Page 4. an appropriate method to.guarantee this performance is available, we are willing• to work with the Applicant to assure that funds are available for, reserved for and spent for this construction project,.and establish a device to accomplish that. If this is Council's desire, then:.the'following procedural steps should occur: 1. The Applicant. -to be instructed to file a plot plan application with the Planning Department.no later than December 7, 1984. 2. The plot plan application should include .a;proposed'and detailed schedule of construction of the residence 3. Applicant shall provide information concerning scurce.of funds to.complete construction and a method to assure tha t'available funds are, in fact,ospent for said construction. Following this alternative, it would be anticipated that approval. would be forth coming at the January•8, 1985, Planning Commission meeting, and that permits could be.processed.within a couple of weeks after that date. Details concerning thea:. construction schedule and available financing would affect the time -necessary to complete the project.from that date. In the event that -the Applicant cannot comply with this.schedule'or,provide the necessary performance guarantees, then`the abatement action should be appropriate. If this'alternative is selected, it would be Staff's recommendation'that a Resolution specifying -findings -.determining the premises to be a public nuisance be brought back to the City Council for consideration at their meeting of December 18th, at which time City Staff would be•directed.to.proceed with the abatement of the.existing structure, including the existing septic system. Within the Resolution, the Community Development Director was.authorized to grant time extensions totalling not ;more than 30,days., At this time, Mr. Jensen has used up the authorized extension and is six weeks behind the schedule established. It does not.appear..that any work.has occurred on the site since late July. Notice has been left on the site, but Mr. Jensen has not contacted us. On September 254- the "temporary power was disconnected as.a•result of Mr. Jensen's failure to correct several safety problems related to electrical power. Under the Resolution, Staff is authorized to abate the nuisance without further hearing. Abatement would involve the removal of"all structures and related improve- ments.
