The purpose of this inspection was to observe work that had been done previously without permits. The La Quinta Building and Safety Department has determined that the current condition of the tenant space is not in compliance with various Building Codes. To clear this property of compliance issues, provide construction documents of sufficient clarity showing compliance with the provisions of the 2007 California Building Code, relevant laws, ordinances, rules and regulations, for the complete scope of work proposed and the work performed previously without permits. Your first alternate option to the first review plan check comments involved qualifying the building as a Type VA.(1- Hr Rated) Building to increase the allowable area for the proposed assembly occupancy. To do this you proposed using fire -sprinklers to substitute the 1 -hour construction requirement. This option was disapproved based on California Building Code Tables 601 and 602. Foot note (a) in Table 602 requires that exterior load-bearing walls must comply with Table 601 where foot note (e) excludes a 1 -hour substitution for the fire resistance rating required for exterior load-bearing walls. Additionally the approved shell building plans were used to justify that an adequate assembly for rated exterior wall construction did not presently exist. A second option was briefly discussed to some how reduce the occupant load in order keep the tenant space in an occupancy group approved at the shell building permitting. This would involve reducing the assembly occupant load to less than 50 persons which allows the tenant space to remain as 'B' and 'M' occupancy groups. If justification was to be provided allowing this option to be approved it would mean that additional construction to provide separation between occupancy groups would not be required. Note: Additional information for review is required prior to approval. A third option not yet brought to our attention as a possibility would be to provide an occupancy separation between occupancy groups per CBC Section and Table 508.3.3. This section will require an analysis to determine the allowable area permitted for the proposed mixed occupancy groups. If itis determined that the existing building, including the existing assembly area of 'Stuft Pizza' will allow additional assembly square footage, the proposed tenant space will require a 1 -hour separation to be constructed between the proposed mixed occupancies ('A' to 'B' or 'M'.) - We are currently awaiting your action on this topic. Accessibility at the existing bar counter was discussed and determined that a minimum code required knee space shall be provided for the entire length of (60) inches. - We are clear about this requirement. A letter from the engineer of record is required to verify there is not a design load at the opening made between unit numbers 109 and 111 that would require additional engineering to be provided justifying the beam design and support. - We are clear about this requirement. Many scenarios were brought up but it looks like as little as 60 square feet may be all that separates us from qualifying the tenant space for 'B' occupancy.
