CALL TO ORDER A. This meeting of the Planning Commission was called to order at 7:00 p.m. by Chairman Kirk who asked Commissioner Quill to lead the flag salute. B. Present: Commissioners Jacques Abels, Rick Daniels, Paul Quill, Robert Tyler, and Chairman Tom Kirk. C. Staff present: Community Development Director Jerry Herman, Assistant City Attorney Michael Houston, and Executive Secretary Betty Sawyer. II. PUBLIC COMMENT: None. III. CONFIRMATION OF THE AGENDA: Confirmed. IV. CONSENT ITEMS: 1. Chairman Kirk asked if there were any corrections to the Minutes of December 23, 2003. Commissioner Tyler asked that Page 4, Item 7 be corrected to read, "...the north side of Avenue 52... "; Page 5, Item 17 "...where a condition was added..."; Page 6, Item 19, "Commissioner Tyler expressed concerns about including the HOA letter..." There being no further corrections, it was moved and seconded by Commissioners Abels/Tyler to approve the minutes as corrected. 2. Department Report: None. Chairman Kirk asked the status of the Highway 1 1 1 Commercial Development Design Guidelines. Community Development Director Jerry Herman informed the Commission it will be on the Council agenda for February 3, 2004. V. PUBLIC HEARINGS: A. Zoning Code Amendment 2003-080; a request of the City for consideration of an Amendment to the La Quinta Municipal Code Section 9.160.080-Semi-Permanent Downtown Village Directional Signs to allow more sign panels and other minor amendments. G:\WPDOCS\PC Minutes\1-13-04WD.doc Planning Commission Minutes January 13, 2004 1. Chairman Kirk opened the public hearing and asked for the staff report. Community Development Director Jerry Herman presented the information contained in the staff report, a copy of which is on file in the Community Development Department. 2. Chairman Kirk asked if there were any questions of staff. Commissioner Tyler asked if a single panel could have a different company on each side. Staff noted it would be allowed. Commissioner Tyler asked that Item C be corrected to read, "However, a sign panel may be ....". He also suggested E.2. be corrected to read, "on no more than two lines". He also asked that alternate fonts may be permitted as noted by the City Council. 3. Chairman Kirk asked if there was any public comment. Ms. Diane Glanz, President/EO for the Chamber of Commerce, stated she would like to request the removal of the installation date. 4. Chairman Kirk asked if there were any questions of the applicant. Commissioner Tyler asked the amount of the demand for the panels. Ms. Glanz stated there is a large demand. They are in the process of acquiring bids for repair of all the signs, but wanted to wait till they had final approval of their request from Council. 5. Chairman Kirk asked if there was any objection to requiring them to keep a copy of the installation date in their offices. Ms. Glanz stated they currently have a list in their offices. 6. There being no other public comment, Chairman Kirk closed the public participation portion of the hearing and opened the project for Commission discussion. 7. Commissioner Tyler stated his concern that some fonts can be difficult to read and he would not like that to be duplicated here. Staff noted the Council has made the decision to allow alternative fonts. 8. Commissioner Quill asked who would decide the font style. Staff stated it would be the decision of the business. PROPERTY OWNER: TOM LATHROP REQUEST: CONSIDERATION OF A SIGN PROGRAM FOR VISTA LA QUINTA COMMERCIAL OFFICE BUILDING LOCATION: NORTH OF AVENUE 47, WEST OF ADAMS STREET ENVIRONMENTAL CONSIDERATION: ON -PREMISE SIGNS ARE CATEGORICALLY EXEMPT UNDER CEQA GUIDELINES SECTION 1531 1(a) GENERAL PLAN DESIGNATION: RC (REGIONAL COMMERCIAL) ZONING: CR (REGIONAL COMMERCIAL) BACKGROUND: Site History The 25,240 square -foot 2-story facility on 13.39 acres, the Vista La Quinta Commercial Office building, was approved on November 20, 2001 (Attachment 1). SIGN PROGRAM PROPOSAL: The applicant requests sign program approval for monument, tenant, and building ID sign areas and locations, for the entire multi -tenant building (Attachment 2). Building -mounted Signs Proposed are 23 illuminated tenant signs, nine on the front elevation fronting Avenue 47, 12 on the rear elevation facing the parking lot, and two on the second story of the rear elevation. All signs are in fixed locations with each sign proposed not to exceed 25 square feet with an "envelope" of 2 X 12.5 feet. Each sign is proposed to have individually mounted internally illuminated channel letters. Letter type is proposed to be Swis 721 DD BT with letter coloring proposed to be black/white, red or aqua with gold trim and bronze returns. Proposed are three illuminated building identification signs located on tower elements on the rear, east and west elevations. Copy for all building identification signs is proposed to read "Vista La Quinta" and are proposed to be the same type, size, style, and color as the proposed tenant signs. Monument Sian One monument sign is proposed to be located at the driveway entrance to the building. The sign consists of two 6' X 6' natural rocks placed back to back with space between the rocks for servicing and adequate landscaping to screen the raceway. Six inch high dark bronze reverse channel "halo" letters are proposed with copy to read "Vista La Quinta 78-900" Window and Directory Signs Proposed are 12 non -illuminated window and door tenant signs consisting of sign areas not to exceed 18" x 18" using machine cut vinyl with letter heights to be a minimum of one inch and with an egg shell color. Copy can include business name and address, hours of operation and a logo. Proposed are three non -illuminated directory signs located at each stairwell and the elevator. Directory signs are proposed to be 3' X 5' and are the same letter type, size, style, as the proposed window/door signs. ANALYSIS: Approval of a planned sign program allows the Planning Commission to make adjustments to sign areas, number of signs, alternative locations, alternative types, and additional heights if findings can be made. This request requires two adjustments: allow one additional building identification sign, and allow 6-inch letters on the proposed monument sign. The Sign Code requires a maximum of two building -mounted ID signs, and freestanding monument signs have a minimum 10-inch letter. Future signs for each tenant will be submitted under the general sign permit process as outlined in the proposed sign program, and will be reviewed for approval by staff using this approved Sign Program. FINDINGS: The following findings can be made in support of the proposed SA 2003-745: A. Sign Application 2003-745 consistent with the purpose and intent of Chapter 9.160 in that it does not conflict with the standards as set forth in said Chapter. B. Sign Application 2003-745 is harmonious with and visually related to all signs as proposed under the Sign Program since proposed are common letter type and size, color and location of signs. C. Sign Application 2003-745 is harmonious with and visually related to the subject building as the scale of the signs and letter color used accentuate the building design. D. Sign Application 2003-745 is harmonious with and visually related to surrounding development, as it will not adversely affect surrounding land uses. E. Sign adjustments to Sign Application 2003-745 can be made in that the proposed signs improve the overall appearance of the project, facilitates good design, provides an orderly and concise signing pattern, and facilitates compatibility with the building architecture. Sign Program 2003-745 for "Vista La Quinta" ATTACHMENT #' Vista La Qui*nta Sign Program Vista La Quinta 78-900 Avenue 47 Sign Program Sign Program: The purpose of the sign Program is to ensure: design, production, implementation, consistency, duality coordination, proportion, enhancement, image and compatibility between all signs within the Sign Program area. As such, the Sign Program is intended to address placement, color, style, sign material, and their consistency on the property. This program also serves to communicate particular tenant sign parameters to compliment the project as a whole, while achieving a unified, attractive balanced appearance. Although the sign Program exhibits establish the letter and sign dimensions, the Sign Program is not intended to substitute Chapter 9.160. of the City of La Quinta Zoning Ordinance. Applicability: A sign program is a coordinated signage plan for an individual building or a group of buildings. For those signs requiring a program, no permit shall be issued for an individual sign unless and until a Sign Program for the lot on which the sign will be erected has been submitted and approved by the City in conformance with the City of La Quinta Sign Ordinance. General Requirement, Standards and/or Provisions: All signs shall be constructed, installed and maintained in accordance with the following standards: 1. All sign (s) shall comply with the Sign Program, current local zoning, meet the provisions of the Uniform Building and electrical codes, be maintained in good structural condition and appearance, and MUST be Underwriters Laboratory (U. L.) and BEAR the U. L. listing. 2. The tenant, tenant's agent and/or the tenant's sign contractor and/or contractor shall be responsible for obtaining any and all permits required. 3. Former tenant (s) shall be responsible for the removal of the signage, including: sealing, patching, painting, and electrical disconnect (s). Removals must be completed within a 10 (ten) day period of lease termination at the tenant's expense. It is required that you use a sign contractor for signage and signage component removal and electrical disconnect, and a painting contractor for fmishing and painting work. All repair work must match the building color and texture. Working area must be left in a neat and clean condition. 4. No audible, flashing, animated, moving, pulsating, electronic and/or search lighting or sign (s) not specifically mentioned herein shall be permitted. 5. It is the responsibility of the owner, owner's agent, or owner's representative to verify all signage locations and/or field conditions, conduit and primary electrical locations and services, prior to installation of any sign (s). 6. No exposed raceways, crossovers, conductors, wiring, or junction boxes. Transformer boxes will be used to cover and/or conceal transformers. All bolts, fastenings, and clips shall be non "rust prone" and/or painted to match the exterior building color permitted. EXCEPTION (S): WHEN THE DESIGNATED SIGN LOCATION (S) HAS SUPPORT BEAMS, NO ACCESS, AND/OR A NON -WORKING AND/OR BUILDING INSPECTOR AREA BEHIND THE DESIGNATED SIGN LOCATION. THE CONTRACTOR MAY USE A RACEWAY THAT IS IN KEEPING WITH THE ARCHITECTURE OF THE BUILDING. THE SIGN FACILITATOR /"RACE WAY" SHALL EMCOMPASS SIGNAGE, STAY WITHIN DESIGNATED SIGNAGE AREA, AND NOT EXCEED/PROJECT FROM LETTERING - SUBJECT TO APPROVAL FROM THE COMMUNITY DEVELOPMENT DEPARTMENT. 7. Sign labels that pertain to construction and installation shall be permitted and placed in a conspicuous location for inspections and/or emergencies. 8. Penetrations of the building structure required by installation (s) shall be neatly sealed in a "water tight" condition and painted to match exterior surface. 9. Sign (s) shall have access and/or adequate "crawl space" for inspection (s) and servicing. 10. No live and/or simulated animals or humans may be used as signage. 11. No sign (s) shall be permitted that propose a nuisance or hazard. 12. No exposed neon, lamps, tubing, and/or bulbs, shall be permitted. 13. Roof sign (s) or projected sign (s) shall not be permitted. 14. Temporary identification signage such as: construction, developer, seasonal promotions and/or compliance non -illuminated advertising displays are permitted as per City Code. 15. Sign (s) that project onto the public right-of-way shall not be permitted. Specifications for Building Signs: 1. Signage shall be individually mounted internally illuminated channel letters. 2. Channel lettering and logo (s) to be fabricated from Aluminum, formed into a pan Channel configuration with a 5-6" (five to six inch) return and flush mounted. Submittal Requirements: A sign application consistent with this program shall consist of the following: For each proposed sign application on the building, the following shall be specified or drawn to scale and dimensioned plans: A) A dimensioned location of each sign in the building and/or property. 13) Sign dimensions including letter height, color, sign length and sign projection from the building. C) Color scheme. D) type style or graphic style. E) Material being used. F) Method of instal lation/attachment/cross section. G) Site plan indicating the location of the occupant space on the site. H) Fabrication and installation details. All permits for sign (s) and their installation shall be obtained by the owner and/or its representative (s). La Quinta Professional plaza and/or its representative shall satisfy all requirements and specifications herein. Binding Effect: No sign shall be erected, constructed, installed, displayed, altered, placed or maintained except in conformance with this program. In case of any conflict between the provisions of this program and any other provisions of Chapter 9.160 of the City Zoning ordinance, the City Zoning Ordinance shall prevail. Approvals: The design and construction of the tenant's signage must receive written approval by the Landlord/Owner or the Management Company and the City of La Quinta before fabrication and installation. The owner's or manager's written approval shall be submitted to the City, along with a completed City application, approved plans, and fees. Owner's approval shall be based on the following: 1. Conformity of the Sign Program established for the center including fabrication and method of installation. 2. Complete information, i.e. contractor's name, company name, address, license number, and workers compensation number. To secure the owners approval, three (3) copies of the design drawing of the signage must be submitted directly to the owner or Management Company. Final Inspection of Sign Installation: The installing sign contractor shall call the City for a final inspection after having installed the sign. 2. The Final Inspection Card must be maintained on file with the Sign Contractor. Signs that deviate from this Sign Program will be removed at the tenant's expense. *Provisional Clause: This Sign Program is intended to address nearly all sign types while adhering to City sign codes and facilitating business operations. It is understood that a tenant could have sign needs that may not "ft'this Sign Program. With this understanding and in all fairness to applicants, landlord and the La Quinta Community Development Department will reserve the right to review proposals on a "case by case" basis. Applicants that fall into this category are: strongly encouraQed to meet with landlord and the Community Development Department prior to sign design to review to exhaust all options prior to using said provision, due to leeal sensitivity and extended lead times of provision: The following situation for a provision: Franchises/Business Opportunities/Operation Systems that specifically mandate certain lettering and/or logos. A letter will be required from tenants on corporate letterhead indicating the businesses noted on # 1 above plus an approval from the owner approving provision. All but one pad site has been sold and approved for development through the Site Development Permit process. SIGN PROGRAM PROPOSAL: The applicant requests Sign Program approval for monument and building/tenant ID sign areas, for the entire project area (Attachment 2). Two buildings have been completed but are not fully occupied; therefore, the Program is designed to be flexible and provide some optional approaches for signing. The Program individually addresses building, monument, and window signs. For continuity and consistency, all sign lettering is proposed as individual reverse channel with "halo" illumination, specifying standard fonts and minimal color variations. P:\Oscar\sa 03-746\sa2003746.rtf Building -mounted Signs Locations of the building -mounted signs are illustrated in the Sign Program, using the elevation of Buildings 3, 4 and 5. Presently, Buildings 4 and 5 are completed with Building 3 under construction. Sign areas are shown for both the upper and lower floor tenant spaces. The typical sign area of each sign is shown as ten inches by nine feet (approx. 7.5 square feet). The City's Sign Code allows one square foot per lineal foot of tenant frontage up to 50 square feet per street or common - use parking lot frontage. Monument Signs Location of monument signs will be at the project entries on Avenue 47, Caleo Bay and Washington Street. These signs will be designed as box -framed pedestals, with the framed area illuminated with double -sided tenant panels, and with the complex identification set as the heading in 6-inch reverse -channel individually illuminated letters. The monument structures will be finished in a smooth plaster coat with Canterra stone wainscot areas and a the cap with a pitched effect, to reflect the Center's architecture. Height of each monument will be no more than eight feet, and the entire monument measuring 36 square feet in area, under the 50 square foot maximum allowed by the City's Sign Code. Window Signs Under the Program, each tenant with entry window facings will be allowed one 18 x 18 inch (2.25 square feet) sign panel area in vinyl letters, which will identify the tenant by name and logo, and the tenant's business hours. These will be uniform in design and are intended to be unobtrusive, information -only signing. Signs for Palm Desert National Bank The applicant is requesting additional signs for the Palm Desert National Bank building, which were approved in March, 2003. The applicant has included in this Sign Program approval additional signs for the bank. Currently, the bank has a small logo sign installed near the ATM on the south elevation, and the bank name installed on the west elevation (facing Washington Street). As part of this Sign Program, they wish to add a second logo cabinet to the building's north elevation, and a second bank name sign to the building's south elevation. Both new signs would be the same size and design as their existing counterparts; the logo cabinet at six square feet and the bank name at 33 square feet. ANA[ YSIS- 1. All aspects of the Sign Program, as proposed, are within the allowable lineal building lease frontage and other provisions of the Sign Code, including the additional bank signs. Future signs for each tenant will be submitted under the general sign permit process as they are identified, and will be reviewed against the parameters of this Sign Program, as approved. 3. The City's sign regulations require that freestanding complex monument ID signs have a minimum ten inch letter size. As this commercial project borders a residential area and is a low intensity commercial office use, the issue of visibility of signs is less significant than in a more intense commercial district with more competitive sign visibility concerns. FINDINGS: The following findings can be made in support of Sign Application 2003-746: A. Sign Application 2003-746, as recommended, is consistent with the purpose and intent of Chapter 9.160 (Signs), in that it does not conflict with the standards as set forth in said Chapter. B. Sign Application 2003-746, as recommended, is harmonious with and visually related to all signs as proposed under the Sign Program, due to the common use of letter type and size, color and location of signs. C. Sign Application 2003-746, as recommended, is harmonious with and visually related to the subject buildings as the scale of the signs and letter color used accentuate the buildings' design. D. Sign Application 2003-746, as recommended, is harmonious with and visually related to surrounding development, as it will not adversely affect surrounding land uses or obscure other adjacent conforming signs. Sign Program 2003-746 �HMENT La Quinta Professional Plaza Sign Program ATTACHMENT 2 La Quinta Professional Plaza Sign Program Sign Program: The purpose of the sign Program is to ensure: design, production, implementation, consistency, quality coordination, proportion, enhancement, image and compatibility between all signs within the Sign Program area. As such, the Sign Program is intended to address placement, color, style, sign material, and their consistency on the property. This program also serves to communicate particular tenant sign parameters to compliment the project as a whole, while achieving a unified, attractive balanced appearance. Although the Sign Program exhibits establish the letter and sign dimensions, the Sign Program is not intended to substitute Chapter 9.160. of the City Of La Quinta Zoning Ordinance. Applicability: A sign program is a coordinated sign plan for an individual building or a group of buildings. For those signs requiring a program, no permit shall be issued for an individual sign unless and until a Sign Program for the lot on which the sign will be erected has been submitted and approved by the City in conformance with the City of La Quinta Sign Ordinance. General Requirement, Standards and/or Provisions: All signs shall be constructed, installed and maintained in accordance with the following standards: All sign (s) shall comply with the Sign Program, current local zoning, meet the provisions of the Uniform Building and electrical codes, be maintained in good structural condition and appearance, and MUST be Underwriters Laboratory (U. L.) and BEAR the U. L. listing. 2. The tenant, tenant's agent and/or the tenant's sign contractor and/or general contractor shall be responsible for obtaining any and all permits required. Former tenant (s) shall be responsible for the removal of the signage, including: sealing, patching, painting, and electrical disconnect (s). Removals to be completed within a 10 (ten) day period of lease termination at the tenant's expense. It is required that you use a sign contractor for signage and signage component removal and electrical disconnect, and a painting contractor for finishing and painting work. All repair work must match the building color and texture. Working area must be left in a neat and clean condition. 4. No audible, flashing, animated, moving, pulsating, electronic and/or search lighting or sign (s) not specifically mentioned herein shall be permitted. i 5. It is the responsibility of the owner, owner's agent, or owner's representative to verify all sign locations and/or field conditions, conduit and primary electrical locations and services, prior to installation of any sign (s). 6. No exposed raceways, crossovers, conductors, wiring, or junction boxes. Transformer boxes will be used to cover and/or conceal transformers. All bolts, fastenings, and clips shall be non "rust prone" and painted to match the exterior building color permitted. EXCEPTION (S): WHEN THE DESIGNATED SIGN LOCATION (S) HAS SUPPORT BEAMS, NO ACCESS, AND/OR A NON -WORKING AND/OR BUILDING INSPECTOR AREA BEHIND THE DESIGNATED SIGN LOCATION. THE CONTRACTOR MAY USE A RACEWAY THAT IS IN KEEPING WITH THE ARCHITECTURE OF THE BUILDING. THE SIGN FACILITATOR /"RACE WAY" SHALL EMCOMPASS SIGNAGE, STAY WITHIN DESIGNATED SIGNAGE AREA, AND NOT EXCEED/PROJECT FROM LETTERING. 7. Sign Contractor must have the following: General Liability Insurance, Workers Compensation, Contracting and City Business License. Tenant will be responsible for its sign contractor to indemnify, defend and hold harmless the Landlord and its agents from any damage or liability resulting from the contractor's work. Tenant will also provide adequate evidence of the sign contractor's insurance coverage, naming the Landlord as additional insured. 8. Sign labels that pertain to construction and installation shall be permitted and placed in a conspicuous location for inspections and/or emergencies. 9. Penetrations of the building structure required by installation (s) shall be neatly sealed in a "water tight" condition and painted to match exterior surface. 10. Sign (s) shall have access and/or adequate "crawl space" for inspection (s) and servicing. 11. No live and/or simulated animals or humans may be used as a sign. 12. No sign (s) shall be permitted that pose a nuisance or hazard. 13. No exposed neon, lamps, tubing, and/or bulbs, shall be permitted. 14. Roof sign (s) or projected sign (s) shall not be permitted. 15. Temporary identification signs such as: construction, developer, seasonal promotions and/or compliance non -illuminated advertising displays are permitted as per La Quinta City Code. Some time restrictions may apply. 16. Sign (s) that project onto the public right-of-way shall not be permitted. 17. The tenant will be responsible for the maintenance of their sign (s). Repairs may be required within 30 (thirty) days of repair/servicing. If not mitigated within 30 (thirty) days, the Landlord may repair and/or service the sign at the tenant's expense. 18. Owner shall reserve the right to have architectural control. Specifications for Building Signs: 1. Signs shall be individual mounted illuminated Reverse ChanneU"Halo-Lit" lettering. 2. Reverse Channel lettering and logo (s) to be fabricated from aluminum, formed into a pan Channel configuration with an approximately 2" - 4" return and "pinned" of the building fascia approximately 1 ''/2". Color Options: Dark Blue or Bronze 3. Letter type style shall be Helvetica, or Optima, or equal. 4. Tenant signs shall include the business name only as registered on the lease agreement. 5. Lettering to be single line copy as noted and shown on elevation. 6. Sign illumination may range from 4500 - 6500 neon or equal with 30 MA transformers. 7. Tenant (s) with nationally recognized lettering and/or logo (s) I. E., trademarks and/or franchises must provide the Landlord and sign contractor copies for permitting. The tenant is responsible for conformance to the type of sign signage area allocations and must be approved by the Landlord and the City Of La Quinta. *SEE PROVISIONAL CLAUSE 8. Sign square footage not to exceed 25 sq. feet for one sign or 50 sq. feet for two signs. 9. Signage to stay within designated area as shown on elevations. 10. Sign (s) shall be double sided. 5. Sign (s) to be internally illuminated by fluorescent lighting. 6. Sign face background to be opaque with translucent copy. Color Options: Black -White, Dark Blue 7. Sign (s) to blend with architecture of building, as depicted on exhibit. 8. Monument sign (s) to have removable copy (maximum of 8 tenants per monument - divider to be painted to match building color). For Sign Program purposes, a building shall be mutually exclusive and "stand alone". 9. Sign (s) shall be constructed out of steel and iron. Surrounding sign portions to be Canterra stone, brick, smooth Tex -coat and paint. 10. Letter type style shall be Helvetica, or Optima or equal. 11. Lettering to be illuminated reverse channel lettering/"Halo-lit' Single line copy. 12. See exhibits for material and location requirements. Specifications for window signs (Secondary) 1. One for parking lot side only. 2. Not to exceed 18" x 18", includes hours of operation. 3. Copy shall be machine cut vinyl lettering. 4. Lettering to be at least 1" in height. 5. Lettering type to be Heivetica (Medium) or Optima, or equal. 6. Lettering to be face or reverse/second surface mount. If tinting prevails on window, it is recommended that a face application process is used. 7. Lettering color to be Egg Shell. Submittal Requirements: A sign application consistent with this program shall consist of the following: For each proposed sign application on the building, the following shall be specified or drawn to scale and dimensioned plans: A) A dimensioned location of each sign in the building and/or property. B) Sign dimensions including letter height, color, sign length and sign projection from the building. C) Color scheme. D) type style or graphic style. E) Material being used. F) Method of installation/attachment/cross section. G) Site plan indicating the location of the occupant space on the site. H) Fabrication and installation details. All permits for sign (s) and their installation shall be obtained by the owner and/or its representative (s). La Quinta Professional plaza and/or its representative shall satisfy all requirements and specifications herein. Binding Effect: No sign shall be erected, constructed, installed, displayed, altered, placed or maintained except in conformance with this program. In case of any conflict between the provisions of this program and any other provisions of Chapter 9.160 of the City Zoning ordinance, the City Zoning Ordinance shall prevail. Approvals: The design and construction of the tenant's signage must receive written approval by the Landlord/Owner or the Management Company and the City of La Quinta before fabrication and installation. The owner's or manager's written approval shall be submitted to the City, along with a completed City application, approved plans, and fees. Owner's approval shall be based on the following: Conformity of the Sign Program established for the center including fabrication and method of installation. 2. Complete information, i.e. contractor's name, company name, address, license number, and workers compensation number. To secure the owners approval, three (3) copies of the design drawing of the signage must be submitted directly to the owner or Management Company. Final Inspection of Sign Installation: The installing sign contractor shall call the City for a final inspection after having installed the sign. The Final Inspection Card must be maintained on file with the Sign Contractor. Signs that deviate from this Sign Program will be removed at the tenant's expense. *Provisional Clause: This Sign Program is intended to address nearly all sign types while adhering to City sign codes and facilitating business operations. It is understood that a tenant could have sign needs that may not "fit" the Sign Program. With this understanding and in all fairness to applicants, landlord and the La Quinta Community Development Department will reserve the right to review proposals on a "case by case" basis. Applicants that fall into this category are strop encouraged to meet with landlord and the Community Development Department prior to sign design to review and exhaust all options prior to using said provision due to legal sensitivity and extended lead times of provision: The following situations are candidates for a provision: Franchises/Busmcss Opportunities/Operation Systems that specifically mandate certain lettering and/or logos. 2. Hardships as set forth in the City Code. A letter will be required from tenants on corporate letterhead indicating the businesses noted on # 1 above plus an approval from the owner approving provision. THIS MUST BE SUBMITTED WITH APPLICATION TO SATISFY CITY OF LA QUINTA COMMUNITY DEVELOPMENT DEPARTMENT SIGN APPLICATION REQUIREMENTS. BE ADVISED: This clause is set forth to be fair and just. Additionally, parking light poles adjacent to Caleo Bay are not to exceed a maximum height of 18 feet, as to further reduce any spill light onto the street. • The average foot candles for the bank area will be 1.9, where as the remainder of the site should fall below an average of 1.7 foot candles. D. LANDSCAPE GUIDELINES Entryways• Areas which serve as a focus of vehicular traffic, such as project entries, should be accented by the use of colorful shrubs and groundcovers for enhanced visual 'interest. • Project entries should utilize vertical accents such as palm trees to provide a sense of arrival to the facility, • Plant materials at project entries should be located so as to avoid interfering with motorist sight lines. THEREFORE, NO FURTHER ENVIRONMENTAL REVIEW IS DEEMED NECESSARY. BACKGROUND: Site Background The subject street is the access street into Tentative Tract 30378 that was approved in June, 2002. The street leading into the tract from Madison Street has existed as an undeveloped street called Beth Circle (Attachment 1). With the new tract the applicants now wish to name the street Norris Drive (Attachment 2). The adjacent property owner to the south on the other side of Beth Circle has submitted concurrence with the proposed name change. Applicable Code Provisions Municipal Code Chapter 14.08 permits an individual to request a street name change. The Planning Commission must adopt a Resolution of Intent setting a date to review the request, no less than 30 days from the date of the adoption of the resolution for p:\stan\snc 2003-015 pc rpt 1.doc a public hearing. The Planning Commission recommendation is then forwarded to the City Council for final action. The Resolution of Intent will be published in the newspaper and posted along the street.
