Dear Mr. Gallant:
On March 20, 1990, the Planning Commission unanimously agreed
that your proposed. covered patio constructed within the 10 -foot
setback is a structure and not permitted. Also, your
alternative of leaving the posts and beam and attaching wires
to the.* beam and home so that Bougainvillea could grow was
considered by the Commission. The Commission unanimously
agreed that this is also a structure and prohibited. The
Commission did indicate that you could apply for a zoning code
text amendment in the future to add clarity to the regulations.
Based upon these decisions, you are required to remove the post
and beam structure by April 5, 1990. Necessary enforcement
will be taken if you fail to comply.
