Mr. Harold,
This letter is in response to your note I recieved on March 1,
1990 in which you inform me that Mr. Moss has agreed to conduct
repairs and cleanup on my property; also that Mr. Moss is requesting
a letter from me saying I will not hold him liable for any damage
during this process.
I will not give Mr. Moss a letter absolving him from any damage
caused by the repairs and cleanup. In the backyard,.the fencing just
needs to be neatly stacked on the patio, which is only three feet
away. The lawn area where the fence is to be corrected is in the
rough anyway, so he need not worry a.bout that, except for cleaning up
behind it once the fence is removed. He and the workers need only
watch so as not to.damage the sprinklers along the patio edge. I
do not foresee a need for them to be elsewhere in the the back.
As for the front yard, the area to be cleared is under and on
either side of the.chainlink fence adjacent to Mr. Moss' property.
I do not expect this fence or the sprinklers alongside it to be
further damaged during removal of the debris -which caused the
original damage. If any sprinklers are damaged I shall expect
Mr. Moss to replace them, as well as correct.anything else he may
damage.
Additionally, I see that the northeast corner of his property
which extends beyond.. the benefits of the retaining wall, is falling
onto my property. I shall expect that situation to be corrected,
as well.
. I also require 24 hrs. notice before repairs.And cleanup are
begun by Mr. Moss, to remove my dogs from the yard. I also
require to be advised if the work will take more than one day so I
can continue to keep .the dogs out of the yard.
When the cleanup and repairs are completed to my satisfaction,
which I will acknowledge in the form of correspondence, I will be
happy to absolve Mr. Moss of any further responsibility,regarding
this incident.

On or about Sept. 26, 1989, Mr. Paul Moss, contractor, began
construction on the lot adjacent to.and south of my property.
This construction has caused infringement on my property and
damage.to my property.
On Sept. 29, 1989, I attempted phone contact with Mr. Moss and
left two messages. I.also contacted Richard Renize of the La Quinta
City planning and developement office. He called Mr.,Moss also.
On Sept. 30, 1989, I was able to contact one of the construction
workers.at the site who had been clearing the lot. He and some
other workers temporarily re -supported my damaged fence.
By Oct. 11, 1989, I had not heard from Mr. Moss or the city.
I attempted phone contact with Mr. Moss again and left another
message. I ,also contacted Richard Rentze again who said he would
contact Mr. Moss. Mr. Moss called me back and agreed to meet at
the property that day. I called Mr. Rentze back and asked to
have an inspector meet" -with us also. Mr. Tom Hartung responded.
At this meeting, Mr. Moss agreed to fix the damage and remove the
dirt that had been pushed up against my property. Later this day,
some of the dirt was moved.
On Oct. 16, 1989, I talked to Mr. Rentze-- and explained the
situation still had not been taken care of. he said he would
contact Mr. Moss and.tell him to put up a retaining wall. At
this time.I asked Mr. Rentze if the order to put up a retaining
wall would get Mr. Moss to remove the debris/dirt off of and away
from my property. Mr. Rentze told me yes, that Mr. Moss would
have to clean all that up.
It is now January 22, 1990. The retaining wall has been
constructed and I believe the house is almost done. .Nothing
has been done in the way of repair or cleanup and in fact the
situation has gotten worse. I am extremely dissatisfied. My
property is still damaged, my sprinkler system has subsequently
been damage and none of the debris has been cleared away from or
off of my property. I am.now also concerned with the drainage
situation presented by the retaining wall.

As a.home owner and.resident of La Quinta, I am asking the
city.to help me resolve these problems with Mr. Moss to my
satisfaction before the final inspection of this:new home and
before a certicate of occupancy is issued. I would like all
correspondence between Mr. Moss and myself to be -directed
through the'Building and Planning department of the City of
La Quinta.
