Dear Ms. Johnson:
It has come to the attention of this department that the structure that you own at
53-424 Avenida Martinez is being rented as two separate units. The area in which
the property is located is designated as Special Residential'. In order to maintain a
second unit in this area a conditional use permit must be obtained ( please see
attachment 1 for details ).
It is apparent that similar zoning restrictions were also in effect at the time that the
permit to enclose the garage and attach to dwelling was issued by the County in
1970. It states on County of Riverside permit # 184322 ( attachment 2 ),. that no
rental of the separate unit, or addition of a second kitchen was to be allowed.
Based on the above information, if you wish to continue the use and rental of the
second unit you must obtain a conditional use permit from the City. You may begin
the application process for the permit by contacting Christine di Iorio in the
Community Development Department.
Failure to acquire the appropriate approvals from the City will necessitate the
removal of the secondary kitchen, as well as the discontinuation of the practice of
renting the structure as two separate units.
Please contact Ms. di Iorio or me within 10 days of the date of this letter so that this
dressed. Failure to do so may result in further. legal action by the
situation may be ad

9.42.010 Purpose.
The SR zoning district is generally appropriate where a density of between four and eight units per acre
is provided for in the general plan of the city. It is intended to provide development standards for single-family
residential uses and to assure high quality development especially in the "Cove" area. (Ord. -95 § 1 (part),
1986: Ord, 5 § 1 (part), 1982: county Ordinance 348 (part))
9.42.020 Allowable uses.
The following uses shall be allowed in the SR zone subject to obtaining a precise plan approval as provided
by Section 9.42.110A:
A. Single-family dwellings;
B. Accessory buildings and uses incidental to the use of the property as a single-family residence;
C. Home occupations (see Chapter 9.208);
D. Small and large family day care homes pursuant to the State Health and Safety Code;
E. Residential care facilities, where the number of residents under care is six or fewer, pursuant to the
State Welfare and Institutions Code;
F. Temporary real estate tract offices located within a subdivision, to be used only for and during the.
original sale of the subdivision (Chapter 9.180);
G. Public facilities and utilities. (Ord. 95 § 1 (part), 1986: Ord. 5 § 1 (part), 1982: county Ordinance

9.42.030 Conditional uses.
The following uses may be allowed in the SR zone subject to obtaining a conditional use permit as provided
by Chapter 9.172:
A. Educational institutions, not including trade or vocational schools;
B. Churches, temples and other places of religious worship;
C. Second unit or "granny flat" within a single-family house pursuant to Section 65852.2 of the California
Government Code;
D. Residential care facilities, where the number of residents under care'is greater than six, pursuant to
the State Health and Safety Code;
E. Bed and breakfast;
F. Nursery schools;
G. Golf course maintenance facility;
H. Timeshare uses as described in Chapter 9.222 of this code;

' 9.42.030
I. Second Units ("Granny Housing"). A second unit which provides for living, sleeping, eating, cooking, '
and sanitation willonly be allowed on a lot or parcel with a minimum of seven thousand two hundred square -
feet or larger. A second unit may be attached, as part of the existing residential unit not to exceed thirty percent
of the existing living area, or a unit may be detached with a square footage not to exceed one thousand two
hundred square feet. This unit is intended for the sole occupancy of one or two persons who are sixty-two
years of age or more, or a handicapped person of any age (and spouse or caregiver).
The following provisions are applicable:
1. The unit is not intended for sale and may be rented;
2. The lot is„zoned for single-family or multifamily use;
3. The lot contains an existing single-family dwelling;
4. a. The second unit is attached to the existing residence and is located within the living area of the
existing dwelling,
b. Whenever an increase in floor area is involved, it shall not exceed thirty percent of the existing living
area,
P. Local building code requirements shall apply to attached structures as appropriate;
5. a. The unit may be a detached. unit which does not exceed one thousand two hundred square feet,
b. Any second unit shall conform to height, setback, lot coverage, architectural review, site plan review,
fees, charges, and other zoning requirements applicable to residential construction in the zone in which the .
property is located,
c. Local building code requirements shall apply to detached dwellings, as appropriate;
6. Approval by the local health officer where a private sewage disposal system is being used, if required;
7. "Living area” means the interior habitable area of a dwelling unit, including basements and attics (if
permitted) and shall not include a garage or any accessory structure;
8. . A minimum of three off-street parking spaces must be provided (two car garage for the primary residential
unit and one space enclosed or open for the second unit). Tandem parking does not qualify for this provision;
9. No more than sixty percent of the lot can be covered ,with permanent/temporary buildings (such as
a single-family home, second unit, accessory buildings, garages, covered patios, guest house, gazebos, etc.).
(In -ground pools, for this calculation, are not part of the sixty percent.) (Ord. 213 § 1 (part), 1992; Ord. 194

9.42.040 Subdivisions and planned residential developments.
These projects are permitted in the SR zone pursuant to the provisions of the municipal land division
(U Quinta 1.95) 230-4
