BACKGROUND:
Site Background
In 1993, the City Council approved Public Use Permit 93-016, under Minute Motion 93-
218, permitting a sculpture school as primary use in a residential area with outdoor
sculpture display at 57-325 Madison Street. Since approval, the property owner has
exhibited the works of various sculptures through paid admission, but has not opened a
teaching facility.
On June 26, 1997, as permitted by Municipal Code provisions, staff approved a private
charity dance at the Park for a maximum of 300 participants and spectators under
Temporary Use Permit 97-142. However, it is staffs understanding from the Riverside

County Sheriffs Department that more than 1,000 people attended the two-day event
which began on June 28, 1997.
Event Request
On June 27, 1997, an application was submitted requesting approval of the a of July
Music Festival, a two-day event that begins on July 5t' at noon and ends on July a at
noon. It is anticipated that over 1,000 spectators will be present for this function. The
applicant's request is attached (Attachments 1 through 3). The event activities will occur
on -site with a majority of the parking occurring off -site on leased property to the south of
the park owned by Mr. Keith Fraser and Pavenham Developments (10-acres). Overflow
parking may occur on the unpaved shoulder areas of Madison Street and Avenue 58 if the
ten -acre temporary parking lot becomes full at any time. Alcoholic beverages will be
served during the event. Temporary facilities will be constructed and catered food will be
provided. The event organizers will be present at the Planning Commission meeting to
explain the event in greater detail.
Zoning Code Provisions
The Planning Commission is required to approve special events in nonresidential areas
if the number of people involved exceeds 300 people including spectators and participants.
The Planning Commission can approve the request provided Findings are made and
Conditions are met. These include health and safety provisions, parking, security, and
traffic related mitigation measures.
Staff Comments
The Riverside County Sheriff's and Fire Departments are currently working with the
applicant to determine security and fire protection needs. Additionally, the applicant has
hired various contractors to help run the event including parking valets, security/first aid
personnel, food caterers and other service providers. Complaints regarding noise and
traffic congestion were experienced at last weekend's event. However, with this approval,
special attention has been given to better accommodating the large crowd rather than 300
people provided measures are taken to control noise, loitering, drinking, parking and
overnight camping. Findings for approval are included in the attached material.
RECOMMENDATION:
Adopt Minute Motion 97- , approving the two-day Music Festival event, subject to the
Findings and Conditions of Approval as attached.

PARADISE FOUND MUSIC FESTIVAL
JULY 3, 1997
FINDINGS:
1. The event will not be detrimental to the health, safety and general welfare of the
community in the area of the proposed event.
A. Various public agency permits are required prior to the event occurring
insuring that the event will be conducted in an acceptable manner. Health
Department permits are required for all food and beverage vendors serving
the event, and police and fire personnel will be on hand to assist the
organizers in providing a safe environment for vehicles and patrons coming
to the event. The public roadways surrounding the project are capable of
handling the local patrons. No problems are anticipated which would be
detrimental to the community based on the recommended Conditions.
B. This project is categorically exempt under Section 15304 (Class 4(e)) of the
California Environmental Quality Act (CEQA) because the outdoor event is
being conducted on an existing 20-acre sculpture park with adequate
facilities to accommodate the daily patrons and public streets will be used
to direct traffic to designated parking areas.
2. There is adequate area to conduct the event and to accommodate the anticipated
attendance.
A. This music festival is held in an adequately designed facility which can hold
the daily patrons because various facilities will be provided such as
restrooms, first -aid station, food and beverages, parking, and other facilities
which provide services to those paying to attend the daily activities. The
Park has existing buildings and landscaping facilities which complements the
other temporary improvements planned for the music festival. The applicant
is proposing on- and off -site parking areas to accommodate guests and
employees for the event. The information is on file with the Community
Development Department.
CONDITIONS:
The following Conditions shall be completed by July 3, 1997 at 5:00 P.M.:
1. A Certificate of Insurance, in the minimum amount of $1,000,000.00, shall be
posted naming the City and its employees as being coinsured for liabilities arising
from the special event.

2. A Certificate of Deposit; in the amount of $3,000.00, shall be posted with the
Community Development Department to insure the off -site parking areas are
stabilized after the event is finished. The City shall be named as the controlling
party for the deposit. All funds will be released when the provisions of Condition
#14 are met, and shall be contingent upon site inspection and submittal of verifiable
cost accounting.
3. A building permit shall be obtained to construct temporary facilities such as
bleachers, tents, stages/dance floors, and provide electrical power to these
improvements, subject to approval of the Director of Building & Safety. A special
inspection fee of $100.00 is also required.
4. Vendors who sell or serve alcoholic beverages shall obtain a license from the State
of California Alcoholic Beverage Control Department. A copy of the special permit
shall be given to the Community Development Department. Alcoholic beverages
shall be served in paper or plastic cups during the event.
The following Conditions shall be completed by July 4, 1997:
5. A fire inspection is required. If you have any questions, please contact Mr. Tom
Hutchison, Fire Safety Specialist, at 863-8886. Fire lanes shall be established
and/or maintained during the special event.
Conditions from each Department are as follows:
Buildinq and Safety Department
6. A minimum of ten portable restrooms shall be provided for patrons and vendors as
required by the Building and Safety Department (i.e., six women and four mens).
Restroom facilities to accommodate the physically challenged (one for each sex)
shall also be provided in addition to allowing use of the existing on -site building
facilities.
7. Any special event lighting shall be directed internally at the temporary stages and
not directed off -site onto adjacent residential properties or affect the vision of
passing motorists.
8. Physically challenged parking spaces shall be provided in close proximity to the
Park entrance that comply with the Americans with Disabilities Act requirements.

Code Enforcement Department
9. The event may be held on July 5, 1997, and begin at noon and end on July 6, 1997,
at noon. The maximum number of guests is 1,500 at any one time.
10. Overnight camping on surrounding properties is not permitted.
11. Temporary trash receptacles shall be provided so that trash/debris can be
deposited accordingly. The site shall be left clean of any litter at the close of the
event.
12. Noises or sounds which are physically annoying to adjacent property owners shall
not be allowed. Noise impacts to receptor land uses surrounding the Park shall
maintain the "A" weighted decibel levels as cited in Section 9.100.210 (Noise
Control) of the Zoning Code (i.e., 55 decibels or less at Park property lines between
the hours of 7:00 A.M. and 10:00 P.M. and 45 decibels between the hours of 10:00
P.M. and 7:00 A. M.).
Finance Department
13. All on -site food and beverage vendors shall obtain a City Business License.
Community Development Department
14. All unpaved areas used for parking or traffic conveyance shall be watered as
necessary to remain damp during event activities. Tracked out mud and dirt from
vehicles onto City streets and any paved area(s) shall be removed or kept damp
until removal can occur. After the event, a soil stabilizer shall be sprayed on these
areas to control dust (Chapter 6.16 of the Municipal Code). A receipt from the
contractor showing that the parking areas have been stabilized shall be submitted
to the Community Development prior to a site inspection.
15. Temporary off -site signs are not permitted unless separately approved by this
Department. A bond in the amount of $200.00 shall be posted to insure that all off -
site directional signs are removed by July 9, 1997. The security can be either a
Certificate of Deposit or Letter of Credit naming the City as beneficiary of the
account, or cash. The security deposit is refundable provided the signs are
removed after the event. The Community Development Department shall receive
the deposit.

Sheriff Department
16. All designated private security personnel must be licensed by the State of California
and possess a current Private Security Guard license if required by the Sheriffs
Department. Riverside County Sheriffs Deputies shall be employed during the
event to provide security and traffic control supervision as determined by their
agency through prior contractual arrangements.
17. Any vehicles that block traffic on Madison Street or Avenue 58 will be towed at the
owner's expense.
Public Works Department
18. Madison Street and Avenue 58 shall not be blocked or barricaded to impede normal
daily traffic movement.
19. An encroachment permit shall be obtained from the Public Works Department if off -
site directional signs in the City's rights -of -way are proposed. Signs in the City
right-of-way shall be mounted on maximum 2-inches by 2-inches wood posts unless
otherwise approved by the Public Works Director. No signs shall be closer than
100-feet from an intersection. Temporary signs shall be posted no closer than 5-
feet from the edge of the paved area of any public road or street and placed a
minimum of 200-feet from an identical sign. Signs in the right-of-way shall not
exceed six square feet.
General Conditions
20. If ground excavation is required, please contact Underground Service Alert (USA)
at 1-800-422-4133. The service is free of charge provided USA is given at least
two days' notice.
21. Before any cranes, forklifts, or other aerial equipment is raised, please check for
existing overhead wires.
22. The City may elect to add Conditions to this application request to mitigate any
problems that arise not previously addressed herein.

4th of July Music Festival
"PARADISE FOUND"
July 5th & 6th, 1997
at LA QUINTA OPEN-AIR MUSEUM
The event is a music festival featuring live and recorded music. It will feature all
types of music, Reggae, Rhythm & Blues, 60's Rock, and modern Rock.
Music industry and recording label staff have been invited to this event to meet
and greet with the artists who are performing as well as attending this event.
There will be one main stage and one small stage, with three D.J. areas
featuring dancing with 60's music, Top 40 and Disco Music.
The will be a Beer Garden area where Beer & Wine will be sold and consumed.
The concessions are being handled by Lindsey Concession (he does the
concessions for the Date Festival each year). Lindsey Concessions will also be
providing food concessions which will be next to the Beer Gardens. There will
be some tables for eating at the concession area.
The Gallery Museum will serve as a VIP area for performers, staff and some very
important guests. There will be a hosted bar in this area as well as food for
these VIP guests.
Insurance
A certificate of Insurance, in the amount of $2,000,000 shall be posted naming
the City of La Quinta as being coinsured for liabilities arising from the special
event.

Restrooms
Portable restroom shall be provided for patrons and vendors as required by the
Building and Safety Department. Restrooms facilities to accommodate the
physically challenged shall be available inside as well as outside.
Lighting
All special event lighting will be directed internally at the stage areas and not
directed off -site or to any adjacent residential properties or streets.
Seating
Grass seating will be used for this event.
Security
There will be a team of 30 to 40 licensed and bonded security officers working at
this event. Their responsibilities will include protecting the event guests, staff
and property. Security services will be provided by KNIGHT M.W.O. Security.
Trash
Trash receptacle shall be provided so that trash or debris can be deposited
accordingly and the site shall be cleaned immediately following the event.
Parking
Two parking lots will be provided at the corner of 58th & Madison.
Physically challenged parking spaces will be provided in close proximity to the
Park entrance and will comply with all requirements of the American with
Disabilities Act.
Lifeguards
Lifeguards will also be on duty for the duration of the event.
First -Aid
A first aid station will be provided with an on duty E.M.T. and an R.N.
