GENERAL PLAN LAND USE DESIGNATION: MIXED COMMERCIAL WITH A NON-RESIDENTIAL OVERLAY. THEREFORE, NO FURTHER ENVIRONMENTAL REVIEW IS DEEMED NECESSARY. SURROUNDING ZONING AND LAND USE: NORTH: W-I/FLOOD CONTROL CHANNEL WITH RESIDENTIAL ZONING FURTHER TO THE NORTH. SOUTH: C-P-S/VACANT LAND WHICH IS PART OF THE 111 LA QUINTA CENTER. EAST: C-P-S/ VACANT LAND WHICH IS PART OF THE 111 LA QUINTA CENTER. WEST: C-P-S / VACANT LAND BACKGROUND: The site is a part of the 111 La Quinta shopping center (SP 89-014) which was approved by the City Council on April 17, 1990. This specific plan indicated a service station and car wash at the site proposed by the Applicant. PCST.067 1 Presently Wal-Mart is under construction at the easterly end of the shopping center. Additionally, Albertsons Market should begin construction soon. A Shell service station was approved in May, 1991 for the corner of Adams Street and Highway 111 within the shopping center. A new plot plan application has been filed for the main shops in Phase II which is located in the middle portion of the shopping center. The Automobile Club has also received approval of an office facility at the corner of Highway 111 and Washington Street. DESCRIPTION OF SITE: The property is an irregularly shaped parcel containing approximately 39, 000+ square feet of area. Presently on the site is a temporary trailer which is used for office purposes and leasing. The site fronts directly on Washington Street and is bordered by a full turn signalized entrance at the northern end of the property and a "in -only" driveway along the southerly boundary of the property. Future buildings are anticipated directly to the south and east of this site. To the north of the site is the Whitewater Storm Channel. STATISTICAL DATA: 1. Number of gasoline islands 6 2. Square footage of sales area for mini -market 2,796 sq. ft. 3. Square footage of canopy 3,190 sq. ft. 4. Parking spaces required and provided 10 PROJECT PROPOSAL: The Applicant has submitted a plan for a service station with a mini -market containing 2,796 square feet. The mini -market will sell groceries, snack items, and beverages including beer and wine for off -site consumption. A detached canopy with six pump islands is proposed. SITE LAYOUT: The Applicant has laid out the service station in a traditional manner with the pump islands and canopy adjacent to Washington Street and the mini -market to the east or behind the pump islands. The building is laid out at a 45-degree angle to Washington Street with parking to the northwest and southwest (or front of the building) . CIRCULATION: The project can be accessed from either Washington Street driveway. Additionally, the site can be accessed from the shopping center to the east. The site is designed so that gasoline delivery trucks enter the site from the in -only driveway at the southern side off Washington Street and exit through the signalized driveway along the northern side of the property. Due to the facilities location within the shopping center, in addition to the on -site parking spaces available, additional parking will be provided to the east and south. PCST.067 LANDSCAPING: The Applicant has submitted a preliminary landscaping plan for the property. The plant materials consist primarily of native and other low water usage plants . No lawn areas are utilized and annual color is kept to a minimum for accent. In the perimeter area between Washington Street and the site, the landscaping will need to be coordinated with the perimeter landscaping which is being provided by the master developer of the shopping center. The Applicant has provided a berm/wall landscaping combination to screen the view of the site from the street. SIGNAGE : The Applicant has indicated sign locations for the property. A monument sign is shown in the landscape area adjacent to Washington Street. Other miscellaneous signs and logos are indicated on the canopy and building. Numerous directional signs will be necessary due to the circulation pattern proposed. The signs will have to be submitted as a separate package and approved by the Design Review Board after approval of the site plan occurs. ARCHITECTURE: The architecture of the project is Southwest in nature with exterior materials consisting of exterior plaster, ceramic the accents, and a tile roof. For the most part, these materials and colors match the main shopping center buildings. Exceptions are that the Applicants wish to use a standard AM/PM white for their exterior stucco and multi. -color AM/PM stripes done in tile above the mini -market entrance. The Applicant has taken the architecture materials and features of the main shopping center building and incorporated them into the design of their building. Therefore, the roof line is somewhat different than that used on the shopping center and as previously mentioned the "white" stucco is slightly different than that utilized in the main shopping center building. DESIGN REVIEW BOARD ACTION: The Design Review Board reviewed this request at their meeting of June 3, 1992. The Design Review Board reviewed the plan as submitted by the Applicant with the gas pumps adjacent to Washington Street. After considerable discussion, the Design Review Board recommended approval of the layout as submitted subject to three conditions of approval. Those conditions dealt with sign program, landscaping and irrigation plans, and provision of additional landscaping and screening if the site plan is approved as submitted. ANALYSIS: Staff has a major concern regarding the layout of the proposed service station. Staff feels that the service station should be reversed with the mini -market adjacent to the street and the pump island and canopy to the rear or to the east side ( screened by the building and bermed landscaping) . The reasons for Staffs opinions are as follows: PCST.067 1. One of the goals of the Washington Street Specific Plan which was adopted in 1986 is to provide an enhanced visual streetscape. To that end, Staff has limited residential and commercial developments to one story near the street and required a high level of architectural treatment. 2. The City has required that service stations be designed in a manner which provides the best architectural treatment. The Shell service station which was approved at the corner of Adams Street and Highway 111 within this same shopping center was required to have a reversed profile. As a result of that, the corner of Adams Street and Highway 111 is architecturally attractive and provides a good gateway into the shopping center. 3. Two new gas stations at the corner of Washington Street and Country Club Drive within Riverside County jurisdiction have been designed with the buildings adjacent to the street and pump islands on the far side. These designs create an attractive appearance. These service stations are not within the City of La Quinta and were required to be designed this way. This shows that other jurisdiction, including Riverside County feel it is desirable to layout service stations in this manner. If the service station is approved as submitted, Staff strongly feels that additional landscaping and berming is necessary in order to provide an acceptable facility. The City has received two letters from the Sheriff's Department pertaining to their preference in site design (see attached) . The circulation for the submitted plan is acceptable to the Planning and Engineering Departments. However any changes to the site design would affect circulation. Staff feels that if this plan is approved as submitted, landscaping must be upgraded and increased within the paved area where it is not necessary for circulation. That would include adjacent to the north side of the parking space labeled 10, the small landscaped island to the east of that area, and the landscaped island adjacent to the southwest entry from Washington Street. Additionally, if this plan is approved, increased mounding will need to be provided surrounding the monument sign adjacent to Washington Street. The architectural style of the building has incorporated a number of architectural features of the main shopping center and maintains the "flavor" of the architecture. RECOMMENDATION: Staff recommends that Minute Motion 92- , approval of Plot Plan 92-482, subject to the attached conditions including redesign of the site plan layout. Attachments: 1. Location map 2. The direction that the market faces may be a problem. When deputies or civilians are driving by the business a blind spot is created. An armed robbery or other criminal activity might be occurring in the parking lot or business but no one will see it. The business acts as a visual obstruction to passing police officers and potential witnesses. 2. The direction also creates a similar situation when pulling into the parking lot. If a crime is occurring as the deputy is pulling into the lot he will have no way of knowing it. This condition may cause a situation to escalate. 3. The back wall of the business or a decorative wall on a major road offers a potential gang graffiti "billboard". Most of the gangs travel from area to area. When the plan for this store was first proposed, the City specified a reverse profile layout at the site. This would not, however, allow a direct view of the establishment from Highway III and would have made the project unsafe for arriving emergency vehicles and patrol units. Because of this, and the possibility of potential security problems, the project was moved to the rear of the site facing Highway Ill. This change in plan has been extremely successful, and we have not experienced any problems in the three years it has been operational. Another safety measure that has assisted in maintaining security was the installation of a panic alarm to alert police to a need for an immediate response. This alarm assists both the employees and police. I would like to thank Arco in all their efforts to both enhance the community and provide a safe place for citizens to do business. Plot Plan 92-482: a request of ARCO Products for approval of plans to allow construction and operation of a gasoline service station and mini- market. 1. Principal Planner Stan Sawa presented the information contained in the Staff report, a copy of which is on file in the Planning and Development Department. 2. Chairman Llewellyn questioned where Staff wanted the pumps to be located. 3. Mr. Craig Yamasaki, representing the Applicant, gave a presentation on the project and the need to not reverse the site layout. 4. Boardmember Curtis expressed his concern that this project not become the traffic nightmare similar to the Palm Desert site. DRBM6/3 Design Review Board Minutes June 3, 1992 0 5. Boardmember Harbison expressed the same concern and a desire to have the building upgraded with better landscaping. Discussion followed between Staff, the Applicant and the Board relative to site layout. 6. Planning Commissioner Barrows asked Staff to explain why they wanted the building reversed. Staff noted aesthetics, Washington Street Specific Plan, and Shell was given the same condition. 7. Mr. Thomas Childers, representing Transpacific Development Company expressed his concern about the site plan and also requested that the building not be reversed due to the security problems and gas fumes that would affect the proposed restaurant directly behind the station. 8. There being no further discussion it was moved by Boardmember Curtis and seconded by Boardmember Harbison to recommend approval of Plot Plan 92-482 to the Planning Commission with site plan as submitted subject to conditions. The development of the site shall generally be in conformance with the exhibits contained in the file PP 92-482, unless otherwise amended by the following conditions. 2. The approved plot plan shall be used within one year of the Planning Commission approval date; otherwise it shall become null and void and of no effect whatsoever. "Be used" means the beginning of substantial construction which is allowed by this approval, not including grading, which is begun within the one year period and thereafter diligently pursued to completion. Approval of this plot plan shall expire on June 23, 1993. 3. All applicable conditions of Specific Plan 89-014, Plot Plan 90-434, and Parcel Map 25865 shall be complied with as required. 4. An exterior lighting plan for parking area and building shall be approved by the Planning and Development Department prior to issuance of a building permit. Lighting fixtures shall be compatible with those used in balance of center. Lighting fixtures shall be shielded to eliminate glare onto adjacent streets. 5. Site plan shall be redesigned so that the mini -market building is adjacent to Washington Street and the canopy and gasoline pumps are to the east of the building. If site plan layout is approved as proposed, a combination berm and wall (garden/retaining) shall be provided adjacent to Washington Street, sufficiently high to screen all gasoline pumps from view of Washington Street to the satisfaction of the City. Additional landscaping shall be provided on site in areas that are unusable and are not necessary for circulation, to the satisfaction of the City. CONAPRVL.059 1 Conditions of Approval PP 92-482 June 23, 1992 CITY FIRE MARSHAL: 9. Provide or show there exists a water system capable of delivering 1500 gpm for a two hour duration at 20 psi residual operating pressure which must be available before any combustible material is placed on the job site. 10. The required fire flow shall be available from a Super Hydrant(s) 6" X 4" X 2-1 / 2" X 2-1 / 2") located not less than 25 feet nor more than 165 feet from any portion of the building(s) as measured along approved vehicular travelways. 11. The required water system including fire hydrants shall be installed and operational prior to the start of construction. 12. Install portable fire extinguishers per NFPA, Pamphlet #10, but not less than 40BC in rating. Contact certified extinguisher company for proper placement of equipment. 13. Applicant/Developer shall be responsible for obtaining underground tank permits from both the County Health and Fire Departments. Installation plans, along with a plan check/inspection fee must be submitted to the Fire Department for review/approval. 14. Final conditions will be addressed when building plans are reviewed. A plan check fee must be paid to the Fire Department at the time building plans are submitted. UTILITIES: 15. Trash enclosure provisions shall be reviewed and approved by Waste Management of the Desert. Trash enclosure shall have solid metal doors mounted on steel poles embedded in concrete, to the satisfaction of the City. 16. All requirements of the Coachella Valley Water District shall be complied with as noted in letter dated May 21, 1992, on file in the Planning and Development Department. ENGINEERING: 17. The access turning movements from Washington Street to the minor driveway access shall be limited to right turn in only. No median opening shall be permitted at this location. 18. The proposed southerly curb alignment for the main entrance road shall be modified to provide a minimum 200 foot radius. Final alignment shall be subject to the City Engineer's approval. The entrance road shall be posted with an R2(15 MPH) speed limit sign. CONAPRVL.059 Conditions of Approval PP 92-482 June 23, 1992 19. A geological, and soils engineering update investigation shall be conducted referencing the existing report, and shall be submitted for review along with the grading plan. The report and update recommendations shall be incorporated into the grading plan design prior to grading plan approval. The soils engineer and/or the engineering geologist must certify to the adequacy of the grading plan. 20. The project grading plan shall be prepared by a registered civil engineer and approved by the City Engineer prior to issuance of a grading permit. 21. Pad elevation(s) shall be, as shown on the plot plan dated April 28, 1992, unless otherwise approved by the City Engineer. 22. The parking lot paving plan shall include all elevations and grades necessary for construction as well as parking lot striping & signage . Handicap parking stall size and quantity shall comply with the Americans with Disabilities Act accessibility guidelines. Striping and signing shall be subject to Caltrans standards, and approval of the City Engineer. 23. Nuisance water and storm water run-off produced in 24 hours by a 100-year storm shall be discharged into the storm drain provided by the master developer, subject to approval of the City Engineer. 24. An oil -water separator, or some other approved alternative shall be provided to trap emergency spills with a minimum capacity of 1,000 gallons. 25. Landscape and irrigation plans shall be prepared by a licensed landscape architect for the landscaped lots. The plans and proposed landscaping improvements shall be in conformance with requirements of the Planning Director, City Engineer, and Coachella Valley Water District and the plans shall be signed by these officials prior to construction. Nuisance water shall not be allowed to flow into the street. 26. On -site landscaping in traffic -control islands and in all unpaved surfaces shall be designed and constructed in conformance with the requirements of the City Engineer regarding sight distance. The proposed 6' screen wall at the northeast corner of the building shall utilize a see -through fence material to avoid impairing site distance. 27. Applicant shall submit a copy of the proposed grading, landscaping and irrigation plans to the Coachella Valley Water District for review and approval with respect to the District's Water Management Program. 28. Applicant shall landscape and maintain the landscaped setback area and right of way between the curb and property line, unless provided by the master developer. APPROVAL TO REVISE PLAN FOR RECREATION LOT AT MARQUESSA ON LAKE LA QUINTA. EAST SIDE OF CALEO BAY, NORTH OF LAKE LA QUINTA DRIVE. This recreation lot was created as a part of Tract 24230 and is intended to be utilized by the homeowners within the subdivision. The lot is an irregularly shaped piece of land containing approximately 2.4 acres and has frontage along the lake. The plan has gone through a number of versions. Initially, in 1990, a preliminary plan was approved which contained a swimming pool, spa, restrooms, club house, boat house, boat dock, several trellis structures, picnic tables and benches, meandering walkways, a promade trellis landscaping, and off-street parking. Since that time, revisions have been approved by the City. The most recent plan approved contained a night -lighted tennis court, boat house, promenade trellis, fountain, putting green, benches and picnic tables, meandering walkways, boat dock, and landscaping. APPLICANT'S PRESENT PROPOSAL: The Applicant wishes to make additional changes to the plan. The proposal is to delete the boat house, putting green, fountain, and shorten the boat dock area. The boat house and putting green area would be replaced with landscaping while the fountain would be changed to a raised planter. Although no benches or picnic tables are shown on the plan there are concrete areas which could accommodate these items. ANALYSIS: To date, two homeowners have purchased residences in the project. Staff felt that these homeowners may have purchased their property at least partially based on the recreational facilities proposed. Therefore, Staff did notify the two homeowners of this meeting in order to allow them to review the plans or voice their opinions. The Applicant indicates that the boat house would only have storage for nine boats which they feel is highly impractical and ineffective for a subdivision of 281 homes. The Applicant feels that the homeowners association would inherit the cost and nuisance of operating, manning and maintaining this facility. On a cost versus benefit basis the Applicant feels it would only make sense to delete the boat house. PCST.066 With regards to the putting green, the Applicant feels that it would be cost prohibitive to the association considering the amount of benefit. The maintenance and care required to properly maintain the putting green is such that they felt it would better serve the homeowner to have alternative facilities for everybodys use. Therefore, they have elected to expand the more passive use park which everyone can enjoy by providing picnic areas and walking trails with benches. The Applicant feels that the tennis court will provide a more active recreation for those desiring it. In conclusion the Applicant feels that these changes will make the park more inviting to the prospective homeowners of all 281 lots while keeping the cost of care and maintenance to an acceptable level. Staff feels that the changes proposed are generally acceptable. The park, if well designed and landscaped, provides opportunities which do not occur on an individual lots. Yours truly, cc: Robert L Pippen Esq. planning Gapt.o City Of La Quinta Jim LaLogginp Wilma BI #3 PLANNING COMMISSION STAFF REPORT DATE: JUNE 23, 1992 SUBJECT: STREET VACATION 92-021 APPLICANT: RICK MORRIS REQUEST: GENERAL PLAN CONSISTENCY TO ALLOW VACATION OF A 40-FOOT WIDE STORM DRAINAGE EASEMENT AT THE NORTHWEST CORNER OF AVENIDA MONTEZUMA AND AVENIDA JUAREZ BACKGROUND: Pursuant to the Government State Code Section 65402, and prior to any street vacation or other public easements being vacated by the City Council, the Planning Commission shall make a finding that the vacation or elimination of said street or easement is consistent with the City's General Plan. On May 29, 1992, Mr. Rick Morris filed an application with the city to vacate the storm drainage easement which lies to the southwest of his home at 51-525 Avenida Juarez. Mr. Morris believes the easement is not necessary now that the City of La Quinta has installed the levee improvements to the west of his home (Bear Creek Channel). Major storm drain facilities within the City of La Quinta are maintained and operated by the Coachella Valley Water District. At present, the storm flood control facilities located on the west and east boundaries of the Cove area consist of natural drainage channels which act as conveyances for storm runoff. A retention basin north of Calle Tampico (Oleander Reservoir) captures storm water west of Eisenhower Drive and directs flow northerly to the existing La Quinta Evacuation Channel. The City and District have completed construction of a storm flood control system which will provide runoff protection from the adjacent foothills south of the Cove area. This new construction is intended to interrupt the storm runoff south, west, and east of the Cove; and provide improved dikes, interception facilities which will greatly reduce the flooding potential within the Cove area. The newer residential areas of the city have been designed and constructed to provide localized storm flood control by the use of concrete curb and gutters, catch basins, and underground piping. The existing 40-foot wide strip was originally dedicated when that parcel was created in June of 1934. STAFFRPT.095/CS -1- PUBLIC AGENCY COMMENTS: Attached are the Agency comments which staff received prior to the meeting. EXISTING GENERAL PLAN GOALS: The following material is from the City's existing General Plan: FLOOD HAZARDS: Issue Assessment - (MEA Reference: II-A.2) Some sections of La Quinta have long experienced flooding due to intense storms of short duration, steep slope run-off from the southern mountains, and the absence of adequate flood control facilities. Implementation Policies: POLICY 3.2.1 - Priority for the use of public funds for construction of flood control facilities shall be given to the relief of flood problems affecting existing development rather than to facilitate new development. POLICY 3.2.2 - The City shall establish a capital improvement program for future flood control facilities. POLICY 7.3.1 - Current policy requiring all new development to provide local storm flood protection should be maintained. POLICY 7.3.2 - The storm flood control system presently under construction for the Cove area by the La Quinta Redevelopment Agency and the Coachella Valley Water District should be expedited as much as possible. POLICY 7.3.3 - Localized flooding within the Cove area should be remedied by the following improvements which should be implemented as soon as possible: o All streets should be fully improved with asphaltic concrete pavement and concrete curbs and gutters; o Gutters should have a minimum height adequate to provide maximum carrying capacity based upon the street longitudinal slope; STAFFRPT.095/CS -2- POLICY 7.3.4 - STAFF COMMENTS• o All anticipated storm water flows exceeding the safe carrying capacity of the street should be handled by underground storm drains; and o A Master Plan of Drainage should be developed as soon as possible to identify various methods of controlling run-off from the lower area of the Cove. The City shall develop and adopt a Master Plan of Drainage as the basis for drainage fee collection per the Subdivision Map Act. Staff has been informed that Palmer Cable has an existing overhead cable line running across this easement. In a verbal conversation two weeks ago, their agency has requested that the City reserve an easement for their purposes if the City elects to vacate the 40-foot. wide easement. Section 8330 & 8331 of the Streets & Highway Code states: "...the City may reserve and except from the vacation the permanent easement and right at any time, or from time to time, to construct, maintain, operate, replace, remove and renew sanitary sewers & storm drains and appurtenant structures in, upon, over and across any street or part thereof proposed to be vacated and pursuant to existing franchises or renewals thereof, or otherwise, to construct, maintain, operate, replace, remove, renew and enlarge lines of pipe, conduits, cables, wires, poles, etc". Therefore at the request of Palmer Cable, we would like to reserve an easement for the cable company to preserve their existing facilities. FINDINGS: 1. The Vacation of the existing 40-feet wide easement at the northwest corner of Avenida Montezuma and Avenida Juarez will not adversely affect the City or impact the City's General Plan. 2. The right-of-way easement is no longer necessary since the Bear Creek Channel was improved in the mid-1980's, therefore making this easement not necessary for flood water diversion. STAFFRPT.095/CS -3- 3. The vacation of said property will not affect the Downtown Village Specific Plan since it is not within the Plan area. 4. A reservation easement should be required for Palmer Cable to secure and benefit their existing facilities per the State's Streets and Highway Code. RECOMMENDATION: By Minute Motion adopt the findings that the vacation of the 40-foot wide storm drainage easement at Avenida Montezuma and Avenida Juarez are in compliance with the Hazards Element and Natural Resources Element of the La Quinta General Plan provided a reservation is made on behalf of Palmer Cable for their existing facilities. I. CALL TO ORDER A . The meeting was called to order at 7 : 04 P.M. by Chairwoman Barrows and Boardmember Marrs led the flag salute. II. ROLL CALL A . Chairwoman Barrows requested the roll call. Present: Commissioners Mosher, Ellson, Marrs, and Chairwoman Barrows. Commissioner Ellson moved and Commissioner Marrs seconded a motion to excuse Commissioner Ladner Unanimously approved. B . Staff Present: Planning Director Jerry Herman, Principal Planner Stan Sawa, Associate Planner Greg Trousdell, and Department Secretary Betty Anthony. III. PUBLIC HEARINGS A. Conditional Use Permit 92-003: a request of Eisenhower Medical Center and La Quinta Medical Development to construct a three story medical center containing approximately 74,500 square feet of gross floor area and confirmation of the environmental determination. 1. Principal Planner Stan Sawa presented the information contained in the Staff report, a copy of which is on file in the Planning and Development Department. 2. There being no questions of Staff, Chairwoman Barrows opened the public hearing. Mr. Paul Senzaki, representing the Applicant, gave a presentation of the project. 3. Commissioner Ellson asked if the offices could be used for any other purpose than medical. Mr. Senzaki stated that probably not since, most general office businesses would want more window area. 4. Commissioner Mosher asked if the Applicant agreed with the conditions imposed by Staff. Mr. Senzaki stated they were in agreement with the exception of Condition #3. They would like the opportunity to present a specific design for the parking lot PC6-9 1 Planning Commission Minutes June 9, 1992 lighting with poles up to 25 feet rather than be restricted to 10- 15 foot poles. Discussion followed regarding problems with parking lot lights. Staff noted a concern to eliminate overspill and glare due to the surrounding residentially zoned property. 5. Commissioner Ellson inquired what the lot coverage of the building to land would be. According to her calculations it would be 39 o and the maximum allowed by the new General Plan would be 35%. Planning Director Jerry Herman stated that we could not impose any conditions based on the Updated General Plan. 6. Chairwoman Barrows asked if the landscaping would be addressed later. Staff stated they would be required to submit detailed landscaping plans for review and approval. 7. Commissioner Mosher asked if child care was to be incorporated into the project and if it would be for employees only. Planning Director Jerry Herman stated this was planned for future phases and their would not be any limitations as to who the child care would service. 8. Commissioner Ellson asked for a clarification on the spelling of the Fringe -Toed Lizard. 9. There being no further discussion, it was moved by Commissioner Mosher and seconded by Commissioner Ellson to adopt Planning Commission Resolution 92-023 approving Conditional Use Permit 92-003 and confirmation of the Environmental Determination, subject to the conditions amending Condition #3 as requested. Zoning Ordinance Amendment 92-025; a request of the City to amend the Municipal Code regarding fencing standards in the R-1 Zone District and confirmation of the environmental determination. 1. Associate Planner Greg Trousdell presented the information contained in the Staff report, a copy of which is on file in the Planning and Development Department. 2. Commissioner Ellson inquired of Staff if fences would be required in the R-1 Zone. Staff stated they would be required for the rear and side yards. Commissioner Ellson then inquired if one acre lots in the R-1 zone would be required to have the same fencing. Discussion followed relative to limitations on lot sizes required to fence their yards. PC6-9 2 Planning Commission Minutes June 9, 1992 3. Chairwoman Barrows opened the public hearing and as no one wished to address the Commission on this subject, the public hearing was closed. 4. Discussion continued between the Commissioners and Staff relative to fencing requirements and possible exceptions. Following the discussion it was moved by Commissioner Mosher and seconded by Commissioner Marrs to continue this item for 30 days (to July 14, 1992) to give Staff an opportunity to look into limitations on Purger parcels of land. Plot Plan 92-485; a request of Dan Featheringill-DoDco Construction to convert an existing single family home into a chiropractic office on 0.24 acres in a Commercial Village "The Core" Zone District. 1. Associate Planner Greg Trousdell presented the information contained in the Staff report, a copy of which is on file in the Planning and Development Department. 2. There being no questions of Staff, Mr. Dan Featheringill, applicant, addressed the Commission regarding Conditions #12.I., W.C., #25.b., #26, and #35. 3. Commissioner Ellson inquired about the limited number of parking spaces provided. Staff replied that the future building would provide the required parking additionally, on -street parking is available. 4. It was noted that where noted in the conditions, Avenida La Fonda should be changed to Calle Fortuna. 5. Commissioner Ellson asked if the Village Specific Plan required a specific type of tree. Staff stated that on some streets certain types of trees were required. It was determine that possibly a Blue Palo Verde could be used on Desert Club Drive rather than the Brazilian Pepper recommended in Condition #12.I. 6. Chairwoman Barrows asked if landscaping would be required. Staff stated they would be required to landscape or screen the parking lot. PC6-9 3 Planning Commission Minutes June 9, 1992 7. Mr. Featheringill addressed the Commission and Staff relative to the time limit to use the structure. He was uncertain as to whether it would be financially feasible to recover the costs in two years as recommended in the conditions. Commissioner Mosher suggested different wording to allow the applicant two years and possible a one year extension. 8. There being no further questions it was moved by Commissioner Mosher and seconded by Commissioner Marrs to adopt Minute Motion 92-019 approving Plot Plan 92-485 subject to the amended conditions. Unanimously approved. B . Plot Plan 92-484; a request of Richard and Patti McCormick to develop a small take-out pizza restaurant in the Commercial Village "The Core" Zone District. 1. Associate Planner Greg Trousdell presented the information contained in the Staff report, a copy of which is on file in the Planning and Development Department. Staff did comment that a request had been made of the Applicant to change the wording on Condition 027 to allow for either a licensed architect or an architectural contractor. 2. Commissioner Ellson stated she again had a problem with the amount of parking. Staff stated this was a take-out business and they are only required to provide parking for the public area. and employees. Discussion followed regarding the parking. 3. Following the discussion, it was moved by Commissioner Marrs and seconded by Commissioner Ellson to adopt Minute Motion 92- 020 approving Plot Plan 92-484 subject to Condition #27 being amended as stated above. Unanimously approved. C . Agenda item Plot Plan 92-485 reconsidered; Planning Director Jerry Herman stated that Mr. Featheringill had requested the Commission reconsider his project. Commissioner Ellson moved and Commissioner Marrs seconded a motion to reconsider Plot Plan 92-485. Unanimously approved. 1. Planning Director Jerry Herman stated that Mr. Featheringill was again concerned that two years would not be enough time to recover the cost involved in the upgrading of the present structure and give him the opportunity to acquire a loan for the new building. 2. Following discussion it was moved by Commissioner Mosher and seconded by Commissioner Marrs to amend their motion and adopt Minute Motion 92-019 approving Plot Plan 92-485 subject to the amended Condition #35 allowing three years for the current structure with a one year time extension. SR Adjustment 92-006; a request of Bruce Swan, Better Building Company, to install a 510" high stucco wall along Calle Sinaloa on the existing property line. 1.
